8VAC20-780-270-A · Based on observation, it was determined that the center did not ensure that areas and equipment of the center are maintained in a safe condition.

Evidence: 1.A nap cot was propped in an unstable manner approximately six inches from a resting child, posing an injury and tipping hazard. 2 The cords for the radios in the four- to five-year-old classroom and in the three- to four-year-old classroom were plugged in and in reach of children. A tablet propped on a shelf was plugged into the wall next to a resting child with the wire hanging down accessible to children in the two-year-old classroom. This poses as a strangulation hazard to the children in care.

22.1-289.035-B-4 · Based on record review and interview, it was determined that the center did not ensure that they obtain a copy of the results of a criminal record and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.

Evidence: 1) The record for Staff #2, (date of hire 03/24/2022) did not contain documentation of a completed criminal record check and child abuse and neglect registry check from outside of the state of Virginia. The sworn statement, signed 3/01/2022, indicated by Staff #2 had previously lived outside of the state of Virginia within the last five years. 2) The record for Staff #3, (date of hire 03/28/2022) did not contain documentation of a completed criminal record check and child abuse and neglect registry check from outside of the state of Virginia within the last five years. The sworn statement signed 3/21/2022, by Staff #3, indicated that they had previously lived outside of the state of Virginia within the last five years. 3) Staff #1 confirmed the required out of state background checks were not obtained for the staff records of Staff #2 and Staff #3.
