Evidence: 1. The following physical plant violations were observed in the center. a. The toddler classroom had peeling paint on the wall in the kitchen play area accessible to children. b. The four and five year old classroom had a broken handle on one of the storage cabinets accessible to children creating a pinching hazard. c. The outdoor playground has several large metal bolts along the perimeter of the area that are approximately an inch and a half in diameter that were protruding out of the ground posing as a tripping and snagging hazard. 2. Staff #1 (Director) confirmed the physical plant violations in each area.

8VAC20-780-340-F · Based on interviews, record review and video footage, it was determined that the center did not ensure that children under 10 years of age always be within actual sight and sound supervision of staff.
Evidence: 1. On February 21, 2023, at approximately 4:25pm, Child #1, age 4 year old, was left outside on the playground alone for approximately 5 minutes. 2. Staff #4 confirmed that while taking out the trash in the later afternoon, they observed Child #1 alone on the playground without adult supervision and with no other individuals on the playground. 3. Staff #2 was approached by Staff #4 that they saw Child #1 on the playground alone without adult supervision. Staff #2 approached Staff #3, child?s teacher, regarding how many children were in their classroom. Staff #3 was not aware that they were missing a child until they were informed by Staff #2. 4. Staff #3 which is Child #1?s teacher, confirmed on a written statement to Children?s Harbor that they were missing a child when back into the classroom from the playground. 5. In reviewing the video footage of the date and time of the incident, Staff #3 is observed lining up the children to go back inside the building from the playground leaving Child #1 alone on the playground. Staff #3 is observed to be ahead of all the children in line not looking back at the class walking and facing forward towards the entrance of the building. 6. In reviewing the video footage of the date and time of the incident, it was observed that Child #1 was alone on the playground for approximately 5 minutes without sight and sound supervision of staff.

The sworn statement signed 01/09/22, indicated Staff #3 had previously lived outside of the state of Virginia within the last five years. 2.The record for Staff #4, (date of hire 02/13/2023) did not contain documentation of a completed criminal record check and child abuse and neglect registry check from outside of the state of Virginia. The sworn statement signed on 02/09/2023, indicated Staff #4 had previously lived outside of the state of Virginia within the last five years. 3. Administrative Staff #1 confirmed the required background checks were not requested or completed for both Staff #3 and Staff #4.

8VAC20-780-280-B · Based on observation, and interview, it was determined that the center did not ensure that hazardous substances such as cleaning materials be kept in a locked place using a safe locking method that prevents access by children.
Evidence: 1. In the first preschool classroom, there was a clear bottle of bleach water on the counter, disinfectant wipes, and an aerosol spray can that were in reach and accessible to children. 2. In the school and common area bathroom, there is an aerosol spray can in reach of children with a warning label stating, ?Danger, eye irritation.? 3. In the second preschool classroom, there was an unlocked cabinet of disinfectant wipes, detergent, and disinfectant spray accessible to children with warning labels stating, ?Keep out of reach of children.? 4. Staff #1 confirmed that the two preschool rooms and bathroom contained unlocked hazardous substances in reach and accessible to children.
