Staff #4 admitted to ?plucking? child #1 (age 3) on June 2, 2026 as a consequence for the child being disrespectful to another staff in the classroom. Staff #4 described ?plucking? as flicking or hitting the child?s ear with their hand. Video footage shows staff #4 used their right hand to flick child #1 in the left ear and strike child #1 in the face. A witness reports observing staff #4 hitting child #1 across the face with an open hand. A staff reported witnessing Staff #4 flicking child #1 on the ear on at least 3 other occasions as a consequence related to the child's behavior.

    The center shall establish and implement procedures for appropriate supervision of all children in care to ensure safety of children. The center?s policy for behavior management and discipline states: ?Our philosophy is that the Center use discipline to teach proper behavior. The children will be explained the rules of the Center frequently so that they will know the guidelines. Once a child understands the rules and disobeys them, hurts others or property, the following developmentally appropriate guidance techniques will be used. These techniques are: 1. Positive reinforcement. 2. Redirection. 3. Time out. 4. Last resort: when a child?s behavior is continually upsetting or dangerous to others, a conference will be called with the parents.? On June 2, 2026, staff #4 flicked child #1 (age 3) in the ear and struck child #1 in the face with their hand. Video footage shows staff #4 used their right hand to flick child #1 in the left ear and strike child #1 in the face. After being struck, Child #1 immediately grabs their face and appears to start crying. Staff #4 admitted to ?plucking? child #1 in the ear as a consequence for disrespectful behavior in the classroom. Staff #4 described ?plucking? as flicking or hitting the child?s ear with their hand. A witness reports observing staff #4 hitting child #1 across the face with an open hand. A staff reported witnessing Staff #4 flicking child #1 on the ear on at least 3 other occasions as a consequence related to the child's behavior. Orientation documentation in Staff #4?s file states, ?No level of physical aggression (hitting, tap, pluck, slap, etc.) will be tolerated at all. Doesn?t matter if parents give you permission or not. (with any of the children)?. Staff #4 initials were next to this statement.

On March 24, 2026, staff #1 threw a shoe at a child (under age 2) after witnessing the child playing on staff #1?s phone that was left on a nearby table.

    **Systemic Deficiency** The center shall establish and implement procedures for: Appropriate supervision of all children in care. The center's policy for drug and alcohol use states, "No employees or individual who performs work for Cornerstone Tender Care LLC is allowed to consume, possess, sell, purchase or be impaired by alcohol or illegal drugs, as defined under federal and/or state law, on any property owned by or leased on behalf of Cornerstone Tender Care LLC." On March 24, 2026, staff #1 was observed by multiple staff members to have abnormal behavior between 8:12am to approximately 2:18pm, including stumbling or unable to stand up, glassy eyes, disorganized speech, and frequently requesting to leave their room. Staff #1 was found to have alcohol on the premises, and multiple staff suspected staff #1 to be inebriated. Management believed they detected the odor of alcohol on staff #1 at approximately 9:30am and had been previously informed that staff #1 had a history of alcohol use in the workplace while employed by a previous employer. Additional information revealed during the investigation related to staff #1?s interactions and supervision of children on March 24, 2026 includes: 1. Staff #1 threw a shoe at a child (under age 2) after witnessing the child playing with staff #1?s phone that had been left on a nearby table. 2. Staff #1 was observed by two staff members to have an interaction with a child (3 years old) where staff #1 attempted to stop the child from walking in the lunchroom. Staff #1 reportedly placed her hand in front of the child?s chest to keep the child from moving forward and caused the child to fall and spill juice on themselves. 3. Staff #1 was alone supervising 9 toddlers (ages 16 months to 2 years) during rest time from 1pm to 2pm.

When a group of children receiving care includes children from different age brackets, the age of the youngest child in the group shall be used to determine the staff to children ratio that applies to that group. In the Infant room, there were eight infants, ages four months to 13 months. One staff was observed taking one infant across the hall into another room for a diaper change, leaving one staff with seven infants. Administration stated this is the normal routine to change diapers in the other classroom. In classroom #1 (16 months through two years), two staff were supervising 12 children. Child #1, 15 months in age, was present in the classroom. One additional member of staff was required.
