8VAC20-780-340-C · Based on observation and interview, it was determined that the center failed to ensure that during the stated hours of operation, there always shall be on the premises when one or more children are present one staff member who meets the qualifications of a program leader or program director and an immediately available staff member with direct means for communication between the two of them.

Evidence: 1. In speaking with all 14 children as a group, they confirmed that there was only one staff member present at the after school program CDC. 2. Staff #1 confirmed that they were the only staff member present at the center supervising all 19 children in care. 3. Staff #3, program manager, confirmed that they were aware that there was only one staff member at the center to supervise children under the age of 12 years old.
