    Based on observation, facility did not ensure areas and equipment of the center, inside and outside, shall be maintained in a clean, safe and operable condition. Evidence: The following was observed during inspection: 1. One of three toilets in the hall bathroom is not operable with a sign "out of order" on the lid. 2. Two signs 4' x 8' were observed propped against the building and fence on the outside playground. The signs were not secured, within reach of children when playing outside and could fall on someone. 3. Two tricycles on the playground were missing a foot pedal. 4. The privacy fence on one portion of the playground did not reach the ground level (approximately 1' opening) and could allow a child to crawl out of the play area. Owner stated trees had recently been removed that had blocked the openings.

    Evidence: Staff #1 stated she popped child #1 while on a field trip on April 4, 2023. Staff #1 stated she did this in response to the child hitting her. Staff #1 demonstrated using the palm of her hand hitting the top of the child's hand and then stating "that hurts". "That hurts, doesn't it?" Staff #1 stated child #1 then cried.
