Evidence: 1. Video footage was reviewed from 5/7/2024. In the video, child #1 (age 4) and child #2 (age 4) were observed sitting behind a shelf in the classroom. For approximately two minutes, the children took turns exposing and inappropriately touching each other with their hands and mouths. In the video, staff #1 is observed sitting in a chair and looking at her phone during the incident. This exchange took place five times before staff #1 (date of employment: 1/30/2023) intervened.

22.1-289.035-B-4 · Based on a review of 5 staff records and interview, the center did not ensure to request the results of a sex offender registry check and child abuse and neglect registry check or equivalent registry within the required time frame from any state in which the individual had resided in the preceding five years for 1 staff member.

Evidence: 1. The record of staff #1 (DOH: 3/31/2022) contained a sworn statement that indicated that the staff had resided outside of the state within the preceding 5 years. The record did not contain the results of a sex offender registry check. Sex offender registry checks are required prior to the first date of employment. The record did not contain the results of an out of state child abuse and neglect search request by the end of the 30th day of employment. 2. Administration acknowledged that the out of state background checks results had not been obtained.
