63.2(17)-1721.1-B-4 · Based on a review of documentation and interview, the center did not ensure that one applicant obtained a copy of a sex offender registry check and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years within the required time frame.

Evidence: 1) During interview, a member of management reported Applicant #1 became a resident of a state outside of Virginia in April 2020. 2) The record for Applicant #1 did not contain a copy of a sex offender registry check or a search of the child abuse and neglect registry or equivalent registry from the state the applicant has resided. An out-of-state criminal history record information check was not required because the state participates in the National Fingerprint File (NFF) program through the FBI. 3) The results of the out-of-state background check searches were required to be obtained by December 31, 2020 for existing applicants prior to July 1, 2020. Applicant #1 was an applicant prior to July 1, 2020.
