8VAC20-780-340-F · Children under 10 years of age always shall be within actual sight and sound supervision of staff, except that staff need only be able to hear a child who is using the restroom provided that: There is a system to assure that individuals who are not staff members or
persons allowed to pick up a child in care do not enter the restroom area while in use by children; and Staff check on a child who has not returned from the restroom after five minutes. 1. On February 7, 2025 Child 1 (aged 3 years) was left in a classroom restroom without supervision from approximately 3:22pm until 3:50pm, approximately 28 minutes. 1. Staff 1 and Staff 2 were present in the classroom at the start of the incident and were aware Child 1 was in the bathroom. 2. Staff 1 was relieved by Staff 3 while Child 1 was in the bathroom. 3. Child 1 was in the bathroom for thirteen minutes without a staff member checking up on them when the remaining students, Staff 2 and Staff 3 took the children to the playground. 4. Child 1 remained in the classroom bathroom in the empty classroom until two parents, (including Child 1's parent) entered the room and found the child in the bathroom at approximately 3:50pm.
