Center management confirmed that Staff #1 was found asleep in the Foglia classroom during the children's rest period on 03/26/2026. Staff #1 was the only staff providing supervision to the group at this time. There were six children in attendance, one of which was awake. The children in this group were two years old.

The centers policies and procedures state that staff shall "ignore [negative behavior] and highlight positive behaviors". "Redirection [should be] used with older children; focus on another positive activity". Staff are encourage to use "verbal cues: praising, suggesting, encouraging, prompting and persuading". When child #1 was displaying negative behavior, staff #1 took the childs backpack and placed it outside of the classroom to gain the childs attention. Child #1 proceeded to cry, kick and bang on the classroom door for their backpack. Staff #1 brought the backpack into the classroom, picked child #1 up and put them on their cot to take a nap. Staff #1 stated "[the child] got up off [their] cot and I put [them] back on the cot. [They] continued to cry so I walked away to help another child."

On 4/21/2025 at approximately 2:00 PM, staff #1 was observed sleeping in the alberello 1 classroom. There were 10 children present between the ages of 3-5 years of age. All children were sleeping. Staff #1 confirmed that they had fallen asleep for approximately 10 minutes.

Evidence: During the investigation, it was approximately 93 degrees outside and program classrooms were approximately 84 degrees. Children's faces were observed to be rosy colored and sweating. Center management stated that the AC broke on 7/7/2023 and that electrical parts needed to be ordered for the repair. There were portable AC units observed throughout the building however the room temperatures on the units ranged from 84 degrees to 95 degrees. Upon follow-up on 7/17/2023, the center had opened in the morning but center management stated that the classrooms could not stay below 80 degrees, so they closed the center at 8am.
