1. Room 1 had crumbs around the eating area and the floor where the children crawled around. Children were eating after-nap snacks, but there was also pieces of green vegetables, from lunch around the cabinets near the linoleum. There were also stains and caked in food particles on the carpet. 2. Room 2 had food and dirt debris along the edges of the classroom floor, and staff stated that the crumbs had been waxed into the floor, and that they could not remove the debris. There were also food crumbs on the carpet, away from where the children were eating.

Evidence: Video recordings for 10/3/2023 and 10/4/2023 were reviewed by La Petite Academy Administration and the Licensing Inspector and the following was confirmed: 1. In the Toddler's classroom, on 10/3/2023 at approximately 2:53pm, Staff #1 was observed standing on one side of a table, while Child #1 (2 years old) was standing close to the table on the opposite side. The center's video recording showed Staff #1 picking up a chair, lifting it over the table and trying to place it between Child #1 and the table. Staff #1 inserted the chair between Child #1 and the table in a manner that caused the child to lose their balance and fall backwards. 2. On 10/4/2023 at approximately 10:35am Staff #1 was observed walking over to Child #2 (14 months old), lifting them from the floor, flipping the child once to place them on their shoulder while walking around the classroom.

Evidence: On July 24, 2023, an ice cream truck stopped at the facility at around snack time. According to staff interviews, after the children from the Preschool classroom had picked the ice cream of their choice, Staff #1 instructed three children in the classroom to give their ice cream back to them because they needed to earn their ice cream. Staff #2 was instructed to not give the ice cream back to them until the end of the day. Staff #2 indicated that ice cream was withheld from Child #1, #2 and #3, while the other children were allowed to eat it because they had not been following directions during the day.

8VAC20-780-340-F · Based on interview and review of the center?s video recording, a child was not within actual sight and sound supervision of staff for approximately 1 to 2 minutes.
Evidence: 1. On June 21, 2023, at approximately 10:43am, the center's video recording shows Staff #1 in the multipurpose room with 11 school-age children. At approximately 10:44am Child #1 (5 years old) is observed walking over to Staff #1 and talking briefly with them. Staff #1 stated that the child asked them to help them put a charm on their shoe, to which Staff #1 replied "no". Staff #1 stated that when they replied no to Child #1's request, the child started kicking and scratching Staff #1. 2. At approximately 10:46am, Staff #1 is observed walking over to the classroom's phone to call administration for assistance with the child. Staff #1 stated that when they called the office they said to them: "Please come get Child #1 before I hurt them" 3. Staff #1 stated that after calling administration they went back to the area where Child #1 was, then Child #1 hit Staff #1 in the stomach. 4. At approximately 10:47am, the center's video recording shows Staff #1 holding Child #1 by their arm and walking them towards a door that leads to a hallway. Staff #1 opened the door, Child #1 walked into the hallway, then Staff #1 proceeded to close the door, leaving the child outside the multipurpose room and out of sight and sound supervision. 5. After Staff #1 called administration, Staff #2 was asked to go to the multipurpose room to assist with the situation. When Staff #2 arrived to the multipurpose room, the door to the hallway was closed. Staff #2 found Child #1 in the hallway, out of sight and sound supervision of Staff #1. Based on the time of the phone call to administration, it's estimated that Child #1 was out of sight supervision for 1 to 2 minutes.

The center staff did not follow its own policies and procedures on 12/12/2022 at approximately 3:53pm when: A) Staff #1 directed Child #1 (4 years old) to sit on a chair, without offering an alternative activity or redirection. B) Staff #1 chased Child #1 around the classroom then grabbed Child #1 under their left arm, placed the child over their shoulder and proceeded to carry the child with their feet dangling off the ground to another classroom. C) Staff #1 pulled Child #1's sleeve to direct them to pick up the chairs the child had kicked to the floor.
