While classroom #1 was outside, two bikes in the play area were missing one of two foot pedals. The large step-on trash can lids in classroom #1 and classroom #2, were detached at one of two connection points in the back of the trash can, exposing sharp plastic.

On December 8, 2025, Staff #1 grabbed Child #1 by the right wrist and pulled the child. Child #1 did not resist their wrist being held. Staff #1 pulled the child's wrist up and pulled the child towards the wall and closer to Staff #1. Staff #1 pulled the child again, and yanked the child's wrist hard upward swinging the child towards the classroom door and lifting the child off of both feet.

Based on observation, the center failed to ensure areas of the center, inside, were not maintained in a clean, safe and operable condition. Evidence: 1. Witness A stated that daily around pickup time, the classroom restroom smells foul. They stated that urine is always on the floor and the toilet is rarely flushed. 2. On January 30, 2024, one out of two toilets in the restroom used by the Ladybugs classroom was observed to contain urine and toilet paper. 3. On January 30, 2024, toilet paper and paper towels were observed on the floor of the Ladybugs? restroom. 4. On January 30, 2024, a sippy cup was observed sitting on the toilet paper dispenser in a bathroom stall in the restroom used by the Ladybugs classroom. 5. On January 30, 2024, one out of two toilets in the restroom used by the Bees and Frogs classrooms was inoperable and contained feces and urine. There was an out of order sign posted on the door. 6. Staff #1 confirmed that the toilet had been inoperable since January 29, 2024 and a plumbing company was scheduled to come out on January 31, 2024. 7. On January 30, 2024, toilet paper was observed on the floor of a bathroom stall in the restroom used by the Bees and Frogs classrooms.

Based on record review and interview, the center failed to follow the center?s own policies and procedures. Evidence: 1. The center has a policy that states ?one week?s notice will be provided for disenrollment, unless the inappropriate behavior jeopardizes the health and safety of other children or members of the Academy?s staff.? 2. On August 31, 2023, the center informed the family of Child #1 (age: 3 years) via email, that ?August 31st will be the final day of enrollment,? for Child #1 and their three siblings. The email indicated that the disenrollment was due to the center not feeling comfortable providing care to the children after a comment was made that the parent will be shutting the center down. 3. The center has a behavior management policy that states, ?our goal is to limit exclusionary measures and will only be considered when the health and safety of the child, other children, or staff is jeopardized.? The policy also states, ?exclusionary measures are not taken unless there is an agreement from all parties that it is in the best interest of the child. If exclusionary measures are taken the program will offer assistance to the family in accessing services and an alternative placement.? 4. Child #1 had four behavior reports about hitting classmates and teachers, and three behavior reports about running from teachers, written between March 27, 2023 and August 29, 2023. On August 29, 2023, the family of Child #1 was notified that the child would be suspended starting August 30, 2023 and could return to school on September 5, 2023. Witness #F confirmed that all parties had not come to an agreement that exclusionary measures were in the best interest of the child. The program did not offer assistance in accessing services and an alternative placement. 5. Witnesses B, C, D, and E all confirmed that there are multiple children who have exhibited behavior issues including hitting, kicking, spitting, throwing toys and running around. 6. Review of behavior reports indicated that Child #2 has had multiple behavior reports written due to choking classmates, wrapping their hands around classmates? necks, shoving, hitting, throwing toys, pulling hair, scratching and biting. Child #3 has had multiple behavior reports written due to hitting teachers, punching a teacher in the face, and kicking. Staff #1 confirmed that Child #2 and Child #3 have not been suspended.
