Video footage from 6/30/2025 showed Child #1 (age 8 years) and Child #2 (age 6 years) in the library area of the school age classroom engaging in inappropriate physical contact. The two children were seen on the library floor and going underneath the table in the corner. After a short time, Child #1 moved the couch closer to the table blocking one side. Child #2 retrieved a chair and a blanket to cover the other side, leaving the top of their heads visible. Based on video footage, the two children were underneath the table for approximately 11 minutes and were seen exiting on their own. The same video footage showed Staff #1 sitting at a table with their back to the library area. The two children were underneath the table for approximately 6 minutes when Staff #1 stood and faced the library area, after the couch and chair had been moved and the table was covered with the blanket. Staff #1 was not able to observe the two children engaging in inappropriate physical contact and did not intervene to offer immediate assistance or guidance. Staff #1 was then observed sitting at a different table, with their back to the library area.

Based on interviews, when staff are supervising children, they did not always ensure their care, protection and guidance. Evidence On June 27, 2024, at approximately 10:00am staff #1 and #2, staff in the Preschool 2 classroom, and staff #3, staff in the Toddler classroom, exited the classroom leaving child #1 (age 32 months) alone in the room. Staff #1 stated that 10 children were lined up at approximately 9:55am for her to conduct name to face before going out to the playground. The classroom became chaotic when staff #3 and the Toddler class with approximately 7-9 children entered the Preschool 2 classroom to exit to the playground. Both classes exited the backdoor of the classroom to the playground. Staff #1 lined the children up on the white fence to conduct name to face and realized child #1 was not present. Staff #2 ran back into the building to retrieve child #1. Staff #1 and staff #2 were not aware a child was left in the classroom. Child #1 was left alone in the classroom for approximately 60-90 seconds. Staff #2 confirmed staff #1 recall of events. Staff #3 conducted name to face for the Toddler classroom.

Staff #2 stated the normal procedures for the name to face check is to have the attendance sheet available in the classroom, record the children's names as they arrive, check name to face at the doorway in the classroom, and check name to face again on the playground. Staff #2 stated that there was no name to face attendance sheet available in the classroom on the morning of 3/7/2024, and the children's names were not recorded as they arrived or departed the classroom. Staff #3 confirmed the policy is to record the children's names on the attendance sheet as it occurs and to conduct a name to face check at the doorway of the classroom and again when entering the playground.
