22VAC40-185-440-G · Based on a review of observation, documentation review, and interviews, the center did not ensure that cribs were used for children under 12 months of age and for children over 12 months of age who are not developmentally ready to sleep on a cot or mat.
1) During the inspection on 07/28/21, the licensing inspector observed 10 children in the infant classroom. The children?s age ranged from 4 months to 15 months. There were a total of 8 cribs observed in the classroom. Three children under 12 months were observed sleeping in swings. 2) During interviews, staff reported the children that were observed sleeping in swings did not have a designated crib at the time. Cribs shall be used for children under 12 months of age and for children over 12 months of age who are not developmentally ready to sleep on a cot or mat.

22VAC40-185-340-A · Based on a review of documents and interviews, the center did not ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.
Evidence: 1) On 04/07/21, at approximately 11:00am, Child #1 (18-months-old) was bit by another child on the playground. Collateral interviews reported approximately eight bite marks were observed throughout Child #1?s body when they were picked up from the center on 04/07/21. Two of the marks broke the child?s skin. 2) Staff #1 completed a written accident/injury report form on 04/07/21 describing Child #1?s injuries: ?We thought the students were hugging but when [Child #1] went to the ground, we went over to dust him off and observed the marks? 3) Staff #1, Staff #2, Staff #3, Staff #4, and Staff #5 were present on the playground at approximately 11:00am when the incident occurred. The staff members were not able to identify how another child bit Child #1 eight times and nobody noticed until Child #1 was on the ground. Three different groups of children (Toddlers, Two?s, and Three?s) were out on the playground on 04/07/21. The staff members reported that when all groups are outside, all staff members are responsible for the care and protection of each child regardless of their assigned group.

8VAC20-780-40-E · Based on interview, policy review, and child record review the center failed to ensure that the center?s activities, services, and facilities are maintained in compliance with these standards, the center?s own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
Evidence: The program director was interviewed regarding a parental complaint concerning their child coming home with diapers full of urine and feces. The program director explained the center?s diapering policy and procedure and provided the policy for the licensing inspector to review. The policy states that ?diapers will be checked every hour and changed every 2 hours regardless of whether they are soiled.? The program director stated that the diaper changes are recorded in Bright Wheels. Licensing inspector requested to review a random child?s record enrolled in the 2?3-year-old classroom to observe how the diaper changes are recorded. The record for C1 was reviewed. Evidence: 1) The licensing inspector viewed facility video footage of the infant classroom from 10/13/2021 and observed the following: a) At approximately 11:07am, Staff #1 is observed placing Child #1 in a high chair. b) Staff #1 is observed turning around after placing the tray on the high chair and walking away from the child. c) Approximately 30 seconds after Staff #1 walked away, the tray and the child are observed falling out of the chair and the child hitting her head on the floor. Staff #1, Staff #2, and Staff #3 are observed rushing over to the child, picking her up, and consoling her. 2) During interviews, Staff #2 and Staff #5 reported Staff #1 did not use the protective belt when Child #1 was placed in the high chair. Staff #2 reported she observed a bump on the child's forehead when they picked her up off the ground. 3) An accident/injury report completed by the facility on 10/13/21 states the following: "[Child #1] was placed in high chair for lunch, [Staff #1] walked over to grab her lunch and she fell out less than one minute after being sat in the chair at 11:07am. She pushed the tray off and fell head first, forward, to the floor." The accident/injury report states: "All three teachers immediately ran to her aid. Ice was applied and rescue squad was notified immediately. Arrived at 11:16am.? Staff #5 reported Child #1 was transported by ambulance to a nearby hospital and was accompanied by Staff #4. The child had bruising and a bump on her forehead as a result of the fall.
