The out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of being hired. An out-of-state criminal background check was not required because the state participates in the National Fingerprint File (NFF) program through the FBI. 2) During interview, a member of management reported the out-of-state background checks for Staff #2 have not been obtained.

22VAC40-185-410-5 · Based on facility video review and interviews, the center utilized the forbidden action of forcing rest when disciplining children for behavior.
Evidence: 1) During interviews, Staff #1 and Staff #2 reported that on 06/23/21, Child #1 (6-years-old), Child #2 (7-years-old), and Child #3 (9-years-old) were asked to lie down on rest mats for misbehaving in class. 2) The licensing inspector viewed facility video footage of the school age classroom from 06/23/2021 and observed the following: a) At approximately 12:45pm, Staff #1 was observed laying Child #1 on a rest mat. Child #1 was observed on the rest mat from approximately 12:45pm until 2:50pm. Child #1 was awake for approximately 1 hour before the child fell asleep. b) At approximately 12:45pm, Staff #1 asked Child #2 to lie down on a rest mat. At approximately 12:49pm, Child #2 was laying on the mat, but was instructed to leave the classroom. Interviews revealed Child #2 was asked to rest outside the classroom under another staff member's supervision due to their behavior. 3) Child #3 was not observed on a rest mat in the video footage reviewed, however, staff interviews revealed that Child #3 was also asked to rest outside the classroom under another staff member's supervision due to their behavior. Child #3 was observed leaving the classroom at approximately 12:46pm.
