Drinking fountains or individual disposable cups with safe drinking water shall be accessible at all times. On 5/26/2026, Staff #1 brought the children's drinking water inside the classroom at approximately 5:00 pm while a group of two year old children played outside until approximately 5:30pm. In interview, Staff #1 stated that they routinely brough the water inside at 5:00 pm when they left for the day. Administration stated that the children could remain outside for an additional 30 minutes to one hour after Staff #1's departure.

The center shall ensure that their activities and services are maintained in compliance with the center's own policies and procedures that are required by the standards. The center's written procedures for safe sleeping state that state that infants are required to always be placed on their backs to sleep in approved cribs with a mattress and fitted sheet only. Infants shall not sleep in equipment other than safety approved cribs. Anything other than a crib is strictly prohibited, including but not limited to and infant carrier, bouncey seat, high chair, swing, or Boppy pillow of any kind. In interviews, staff stated that Child #2, age 8 months, was regularly allowed to sleep in a bouncer seat and was not relocated to their crib. On 5/13/2026, an infant wearable sleep sack was observed in the corner of an occupied crib where Child #1, age 10 months, was sleeping. Administration acknowledged that the incidents were a violation of the center's safe sleep policy.

On 3/23/2026, Child #1, age 4, sustained an injury while in the care of the center. Staff stated that the child did not have any visible injuries upon arrival. At pickup, the parent of Child #1 observed a red mark on the child's face. Staff were unaware of how the injury occurred. Child #1 stated that Staff #1 kicked him in the face during nap.

1. On 3/13/2025 at approximately 4:27 pm, child #1 tripped and struck his forehead on a paved area of the playground. A quarter sized hematoma appeared within a few minutes. Child #1 was immediately brought inside for an evaluation by management and was returned to the playground within an approximate 5 minute window to sit with ice. Three witnesses stated that shortly after the head injury, child #1 demonstrated signs that were compatible with a serious head injury to include stumbling while walking and not being as verbally responsive when spoken to. Injury report documentation indicated that child #1's parent was notified via phone call at 5:05 pm, approximately 38 minutes from the time of injury. 2. Child #1 was taken to a medical facility and diagnosed with a concussion.
