8VAC20-780-330-B · Where playground equipment is provided, resilient surfacing shall comply with minimum safety standards. The fall zone is 6 feet around moving pieces of equipment that required resilient surfacing of 6 inches.

The two trikes on the playground have approximately 4 feet between them and they should be at least 6 feet apart.

8VAC20-780-340-A · When staff are supervising children, they shall always ensure their care, protection, and guidance.

On 2/14/2025, child #1 (age 4 years, 2 months) was left unattended by center staff for undetermined time but possibly for between 3-6 minutes in the public school hallway. School personnel #1 found the child in the hallway outside the classroom. Center staff #1 was in the hallway and noticed child #1 with the school personnel and got the child and brought back to the classroom. Center staff #2 and #3 were on the bus when they realized child #1 was not on the bus and went back to the school to locate the child.

8VAC20-780-60-A · The center shall keep a file for each child that should have documentation of the child's identity and age.

Child #3 did not have documentation of identity and age.

22.1-289.035-B-4 · Based on record review, the center did not complete all the required out of state background checks.

Evidence: Staff #3 indicted on the sworn disclosure form they had lived out of state in tow states in the last 5 years and the criminal background checks had not been completed prior to being hired.

8VAC20-780-330-B · Based on observation, the center did have the required depth of resilient surfacing on the playground.

Evidence: The mulch around the slides was approximately 3-4 inches.

8VAC20-780-330-B · Based on measurement, the center failed to maintain the required resilient surfacing depth and fall zone.

Evidence: 1. The mulch around the three slides and 2 climbers had mulch 2-3 inches in the fall zones. The required depth is 6 inches. 2. The red tricycle piece of equipment had approximately 4 feet of use fall zone around it, and the required fall zone is 6 feet. 3. The picnic table is in the fall zone of the slide.
