22VAC40-185-340-F · Based on staff interviews, the facility did not ensure that all children under 10 years of age always shall be within actual sight and sound supervision of staff.

Evidence: 1) At approximately 10:00 a.m. on May 21, 2021, Staff #1 walked Child #1 (age 5) to their classroom. Staff #1 reported she called out the child's name, left the child in the classroom, and walked back to the lobby. When Staff #1 was walking to the lobby, she passed Staff #2 in the hallway. Staff #2 went to the classroom and found that Child #1 was alone and unsupervised. Staff #1 acknowledged she did not check if there was anyone in the classroom when she left Child #1. It is estimated that Child #1 was out of sight and sound supervision of staff for approximately 1 to 2 minutes.

8VAC20-780-160-A · (Repeat Violation) Based on a review of eight staff records and interviews, the center did not ensure three staff members shall submit documentation of a negative tuberculosis screening within the required time frames.

Evidence: 1. The tuberculosis screening in the record of Staff #5, employed on 05/20/24, was completed on 06/26/23. 2. The record of Staff #6, employed on 05/31/24, did not contain documentation of a negative tuberculosis screening. 3. The tuberculosis screening in the record of Staff #8, employed on 05/20/24, was completed on 09/15/22. 4. During interview, a member of management confirmed the tuberculosis screening for Staff #5 and Staff #8 were completed more than 30 days prior to employment and a negative tuberculosis screening for Staff #6 could not be located. Documentation of the screening shall be submitted at the time of employment and prior to coming into contact with children. The documentation shall have been completed within the last 30 calendar days of the date of employment and be signed by a physician, physician's designee, or an official of the local health department.

Evidence: The center's policy on behavior management was not followed on 03/01/2024 when Staff #1 spanked Child #1 (3-year-old) when Child #1 was not ready to nap. The center's Behavior Management policy was reviewed. The policy states, ?Staff must model positive behavior and use only methods of discipline which encourage self-control, self-direction, self-esteem, and cooperation among children displaying a respect for themselves, their environment, and others with whom they come in contact? and ?Under no circumstances is any kind of abuse, physical punishment, deprivation, or ridicule used as a form of discipline.?
