8VAC20-780-340-F · Based on interviews, the center did not ensure children under 10 years of age shall be within sight and sound supervision of staff.
Evidence: Child #1 and child #2 were in a back office unsupervised for approximately 8 minutes per staff and the parent of child #1. On March 11, 2024, at approximately 4:30 PM, staff #1 and staff #2 transitioned the toddler class from the playground back to their classroom. It was reported that staff did not complete name to face check when entering the toddler classroom. The parent of child #1 (18-month-old) entered the classroom to find that the child was not in the classroom. Staff #1, staff #2 and the parent of child #1 began searching the building for child #1. When staff were unable to locate child #1, they notified an administrator and other staff. At approximately 4:40 PM, child #1 and child #2 (18-month-old) were found in a back office inside of the preschool.

Evidence: On 1/22/2024 between approximately 1:15 PM and 1:30 PM, staff #1 witnessed staff #2 take a pacifier from child #1 (2-year-old) . Staff #1 reported that child #1 was being weaned off the pacifier. When staff #2 took the pacifier from child #1, the child became upset and began to cry. Staff #1 reported that staff #2 became aggressive and confrontational with the child. Staff #2 begin forcefully rolling child #1 onto the child?s stomach and forcefully smacked child #1?s hand. Staff #1 stated that staff #2 then forcefully held child #1?s head down on the mat that the child was resting on. Child #1 then begin to scream and staff #2 snatched the child from the mat and stood the child up. Staff #2 then told child #1 that she would throw away the pacifier and then placed the child back on the mat. Child #1 continued to scream and staff #2 continued trying to hold child #1 down on the mat for approximately 1 to 2 minutes.
