EVIDENCE: In the staff lounge there was a working electric drill sitting on the table in the middle of the room. In the staff lounge there was a bottle of Tylenol and a box of EmergenC supplement in a storage container sitting on the snack table, beside the snacks. The storage container was accessible with no lid.

8VAC20-780-400-B · Based on a self-report, review of video footage, and review of documentation the facility failed to ensure that behavioral guidance is constructive in nature, age and stage appropriate, and redirects the children to appropriate behaviors.
Evidence: Video footage for 1/24/24 showed staff #1 engaged in inappropriate behavior guidance with child #1 who is preschool aged. At approximately 8:36am on 1/24/24 child #1 is seen taking a toy from another child. Staff #1 sees this and approaches child #1 and takes the toy and gives it back to the other child. Child #1 is then seen throwing a toy onto the table top because of this. Staff #1 then grabs child #1 by the upper arms and shakes the child aggressively several times while talking to him close to his face. The video has no sound, but staff statements stated that "staff #1 was heard telling the child we don't do that here, do you want me to smash your tablet?" Staff #1then lets go of child #1 and the child goes to the ground crying.

Evidence: Video showed that on 10/23/23 at approximately 10:39am, while playing outside on the playground, a staff member grabbed the hood of child #1 and pulls the child down backwards onto the ground from a standing position. Child #1 had just done the exact same thing to child #2 a moment before. The staff member used inappropriate non-constructive behavior guidance in this instance by physically engaging the child.

Evidence: On 4/14/23 at approximately 11:25am staff #1 failed to ensure the care, protection, and guidance of child #1 when she observed her standing on the lunch table. The staff did not speak to or go to the child to get her down, she watched her continue to stand on the table and then jump off directly towards another adjacent table where she landed feet first on the floor. This action posed a risk to the child, as the child could have hit her face on the adjacent table.
