63.2-1509-A · As a mandated reporter, an individual in charge of a child day center who receives a
report of suspected abuse or neglect from an employee shall report immediately to the local department or to the Department's toll-free child abuse and neglect hotline. On 5/30/25, at approximately 1:40 p.m., a staff member sent pictures of red marks on Child A?s face to Manager #2, and later informed Manager #2 that they witnessed Staff #1 cause the red marks on Child A?s face. A second staff member also reported that they shared their concerns about the incident with Manager #2. Manager #2 failed to report staff?s concerns as required to the local department.

Staff are able to be provisionally hired once the request has been submitted, if all other background check results are received, but must be supervised at all times by a person who has all of the required current background checks.

On 8/5/25 during afternoon snack, Staff #1 was observed sitting next to Child A (four-years-old) at the table. Child A put their face close to their bowl of cream cheese and Staff #1 quickly pushed the child?s face into their cream cheese. Child A?s face was observed to be covered in cream cheese. Staff #1 began to laugh and gesture to another staff to show what they had done to the child. Child A reported that they cried and it hurt. Staff #1 continued laughing with the other children even after seeing Child A was upset.

Evidence: On 5/23/24 Child A, six-years-old, and Child B, nine-years-old, entered ?the Art Room? by themselves and closed the door. For approximately two minutes the children remained in the closed classroom by themselves, climbing on top of and walking across tables. After approximately two minutes Child B opened the door and exited the classroom and Staff #1 was then observed entering the classroom to remove Child A.
