Cosmetics, medications, or other harmful agents shall not be stored in areas, purses or pockets that are accessible to children. On 07/25/2025, staff #1 had a vape pen in their pocket while supervising children. Based on video surveillance, the vape pen dropped out of staff #1?s pocket where children found the vape pen on the floor and were in possession of the pen for approximately 35 minutes.

8VAC20-780-340-A · (Repeat Violation) When staff are supervising children, they shall always ensure their care, protection, and guidance.

On 05/12/25 when Child #1 (two-year-old) was picked up, his diaper was soaked and soiled. A collateral interview reported the child?s ?butt was raw and bleeding? and the child screamed when his diaper was changed. Management acknowledged seeing a diaper rash and redness at the end of the day when it was brought to their attention. The child was visibly walking with discomfort and said ?ow? when he was carried. Staff interviewed reported Child #1 did not have a diaper rash in the morning or throughout the day, and reported the child?s last diaper change was between 2:45pm and 3:30pm. Child #1 was picked up at 4:52pm. The center failed to protect Child #1 by not ensuring he was promptly changed when his diaper became wet or soiled causing the child to have a diaper rash.

On 03/12/25, Child #1 (2-year-old), was standing on a chair, lost his balance, fell, and hit his head on a chair. The child?s forehead was swollen and had a visible bump and a bruise. The center did not immediately communicate the head injury to the child?s parent. The parent was contacted approximately six and a half hours later.

8VAC20-780-160-A · Documentation of a negative tuberculosis (TB) screening must be submitted at the time of employment, before coming into contact with children, and shall have been completed within the last 30 days of the date of employment.

The TB in the record of Staff #1 was obtained 20 days after employment. A previous TB in the record expired over a month prior to the staff's first day of employment.

Two out of three written injury reports reviewed for Child #1 (19-months-old) did not contain documentation on how the parent was notified of the child's injuries.

There were 21 written injury reports for Child #1 (23-month-old) ranging from 08/12/2024 through 01/21/2025 that were reviewed. Five of the injury reports were signed by the parent the day after the injury. It was determined the center did not notify the parent until the parent inquired about the injuries.
