The center?s policy for positive child guidance states that staff are to, ?praise children for good behavior and re-direct children?s attention and engage them in a positive activity." Staff # 2 stated in an interview on 2/04/25, that Child #1 (age 18 months) would routinely take off his shoes and socks. On 01/22/2025, Child #1 took of his shoes and socks. Staff #2 wrapped packaging tape around the shoes of Child #1 to prevent Child #1 from being able to remove them.

KinderCare policy states that ?Aside from transition times, you must complete and document name-to-face checks on the Child Supervision Record eight times a day.? No Name-to-Face Checks were completed in the Pond room at 4:00 p.m. or 5:00 p.m. as required on 4/28/2025. Child #1, age 22 months, left the classroom through the door that opens to the playground at 4:00 p.m. Video footage showed Child #1 alone and unsupervised on the playground until Staff #3 from another classroom saw her at 4:12 p.m. Staff #3 then took Child #1 back to her classroom.

Evidence: In an interview on 08/06/24, Staff #1 acknowledged that she used a tone she shouldn?t have and handled Child #1 (age 22 months) roughly. Staff #1 was observed grabbing Child #1 in an aggressive manner to get the child to sit back down on her cot. An incident report in Child #1?s record and a coaching form in Staff #1?s record corroborated Staff #1?s account of the incident. In an interview on 8/06/24, the Program Director acknowledged that Staff #1 admitted that she handled Child #1 roughly.
