22VAC40-185-40-K · Based on staff interviews, and documentation review, the center failed to have written playground safety procedures which include provision for active supervision by staff to include positioning of staff in strategic locations, scanning play activities, and circulating among children. Evidence: there was no documentation of written playground safety procedures that included provision for active supervision.

22VAC40-185-410-1 · Based on interviews and review of documentation, a staff member used a forbidden action - striking a child. Evidence: On 8/9/2021 between approximately 3:30-3:40 pm, Staff #1 was sitting next to Child #1 outside on the playground with a drink. Staff #1 noticed that Child #1 (age 4) picked up their drink and took a sip. Staff #1 asked Staff #2 if Child #1 did take a sip, and Staff #2 said yes they did. Staff #1 then "popped" Child #1 in the mouth. Staff #2 stated that they witnessed Child #1 crying after this happened.
