8VAC20-780-410-1 · Based on interviews with staff and children and documentation review, it was determined that staff engaged in a forbidden action of physical punishment with a child.
Evidence: 1) Staff #2 stated that on 06/06/2022, at approximately 8:50 am, Child #1 (6 years) approached Staff #2 in the gym and said that Staff #1 had kicked her on the leg. Staff #2 stated that Child #1 was crying and, upon examining Child #1, noticed a red area and a small scratch in the inner area of the child's left thigh. Staff #2 gave the child an ice pack to apply on the area. 2) Child #1 stated that while in the gym, she approached Staff #1 and "kicked" Staff #1 and Staff #1 "kicked me back". When asked where Staff #1 kicked her, Child #1 pointed at their inner left thigh. Child #1 stated that she cried and went to Staff #2 to tell them what had happened. 3) Child #2 (10 years) stated that while in the gym talking with Staff #1, Child #1 approached Staff #1, made a fist and kicked Staff #1 on the leg. Child #2 stated that Staff #1 immediately kicked Child #1 back on the leg. 4) An injury report dated 06/06/2022 and signed by Staff #2 and Staff #3, describes the incident as: Child #1 "kicked" Staff #1 and Staff #1 kicked them "back on the thigh". This document described the type of injury as a "reddish bruise on the thigh. Noticed there was a fine line about 2 inches there."
