8VAC20-780-80-A · For each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.
1. A child from the Toddler room was transitioning to the Two's room. The child was not checked out from the toddler room upon his departure. 2. Children from several classrooms had gone two staff members for an indoor basketball class. These children were not checked out of their respective classrooms upon their departure.

1. On 6/12/25, Child # 1 was placed in their crib for 1 hour and 19 minutes for nap. 2. There were three staff members in the classroom during this time. 3. Staff # 1, Staff # 2, Staff # 3 and Staff # 4 stated that when an infant is placed in the crib they are checked approximately every 20 minutes. 4. A review of the video footage from 6/12/25 showed that Staff # 3 placed Child # 1 in the crib at 12:17pm. Staff # 4 took Child # 1 out of the crib for a meal at 1:36pm. 5. During this time, Child # 1 did not fall asleep. It also showed that Child # 1 was not checked on during this whole time by any of the staff members present in the room.

8VAC20-780-40-E · The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
The center's medication policy states that "Unused or expired medication will be returned to the parent/guardian when it is no longer needed or be able to be used by the child". Child # 1's emergency medication expired in November 2024, and had not yet been returned to the parents. Child # 2' emergency medication expired in December 2024, and had not yet been returned to the parents.

8VAC20-780-500-B · When a child's clothing becomes wet or soiled, the child shall be cleaned and changed immediately.
1. On 12/5/24, a photograph taken by staff at 3:30pm and viewed in the digital parent communication program showed that Child # 1's pants were soiled. There was a light brown stain on the right back side of the bottom of the child's pants. The photograph was taken after the children had woken from nap and were doing an activity on the rug. There was no documentation on the electronic parent communication system to show that Child # 1 had been taken to the bathroom between 12:15pm till the child left for the day. 2. One witness stated that when Child # 1 was picked up at 4:00 pm, Child # 1's pants and underpants were wet, smelled of urine and had a visible stain. The witness changed the child into clean clothes and pull up at that time.

Three of four staff members interviewed stated that Staff # 1 did not use age and stage appropriate behavior guidance for children in care between three to four years old. 1. One of three staff members interviewed stated that Staff # 1 has been observed using phrases such as "Go sit down" using a high tone of voice in response to which some children in the three's classroom have cried. 2. A second staff member stated that Staff # 1 has been observed using phrases such as "You are short, grow taller", "Dog" and "Li'l Homie" to a 3 year old child in care. 3. A third staff member interviewed stated that Staff # 1's tone of voice and verbal remarks such as mentioned above have been addressed with Staff # 1.

Evidence: 1. Child # 1 ( 2 years old) sustained an injury while in care on 3/13/24. Staff # 1 stated that the child's injury required outside medical care. 2. The center did not report this injury to the department.

The three and half to four year classroom's written attendance was missing the check outs for 7/17/23; and no written attendance was recorded for 7/18/23. Additionally, 4 children had arrived on 7/19/23 in the morning whose written attendance was not recorded as they arrived.

The center did not submit or obtain results of a criminal history check for California prior to Staff #1's first day of employment. The results have not been obtained to this date.

Evidence: 1. On 8/31/21, Child # 1 in the three?s classroom wore another child?s used face mask for part of the day. 2. On the program used by the center to update and communicate with parents, two pictures on 8/31/2021 at 10:15 am and 11:01 am showed Child # 1 wearing his own mask brought from home. Two pictures from 4:37 pm and 4:50 pm showed Child # 1 wearing a navy blue mask which did not belong to him. 3. The daily report message from 8/31/21 included a comment from Staff # 1 to Child #1?s parent at 5:55pm stating ?Oh my goodness. I am terribly sorry. We place the masks on a table when eating and I must have switched his mask. It will not happen again?. 4. During the staff interview, Staff # 1 stated that staff ask the children to place their masks in their cubbies when going on the playground. Staff # 1 stated that after returning from the playground, children reach into their cubbies to get their masks back on. Staff # 1 stated that she thinks Child # 1 accidentally took another child?s mask and put it on.
