22VAC40-185-130-A · Based on review of six children's records, the center failed to ensure that all immunizations were obtain prior to the enrollment date.

1. Child # 1 start date was 10/28/2020 and the date of the immunization was 1/11/2021. 2. Child # 3 start date was 7/28/2021 and on the day of the on site inspection there were no immunizations in the child's record. 3. Child # 4 start date was 1/18/2021 and on the day of the onsite inspection there were no immunizations in the child's record. 4. Child # 6 start date was 12/29/2020 and the date on the immunizations were 1/25/2021.

Evidence: The moveable small red slide on the playground was located over dirt and grass and not over an acceptable form of resilient surfacing; children were observed using the slide during the inspection.

Based on document review, the center failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia. Evidence: The record for Staff 5 contained a documented hire date of 10/04/2023; the employment eligibility letter for Staff 5 was dated 10/10/2023.

8VAC20-780-340-A · Based on photographs and staff interviews, the center failed to ensure that when staff are supervising children, they shall always ensure their care, protection and guidance.

Evidence: On 01/25/2024 Staff 2 was notified that upon arriving at home from care that day, the parent of Child 1 (age 9 months) discovered that Child 1?s Velcro bib had been tied tightly in a double knot around their neck. Pictures of Child 1 show that the bib was double-knotted and tied tight enough to leave a visible red mark around the child?s neck. It was determined through staff interviews that Staff 1 had tied the bib around Child 1?s neck. Staff 1 did not ensure the care and protection of Child 1 when she tied the bib tightly around the child?s neck.

Based on video footage and staff interviews, the center failed to ensure that when staff are supervising children, they shall always ensure their care, protection and guidance. Evidence: Video footage from 11/29/2023 shows Staff 1 putting 5 children (ages 3 years and 4 years) into the backseat of a mid-sized car. Based on Staff 1 statements, the same 5 children were transported to the center for afterschool care on 11/28/2023 and 11/29/2023 in the mid-sized car that was their personal vehicle. Staff 1 stated that one child got into a car seat that was in the backseat of the car and the other four children were also in the back seat buckled into the same seatbelt and not in a child restraint device. The children were transported approximately 3 miles. The Code of Virginia requires that any child, up to age eight, shall be properly secured in a child restraint device of a type which meets the standards adopted by the United States Department of Transportation. The center did not ensure the care, protection and guidance for the children during their transportation to the center when four preschool age children were transported in a mid-size care without the required child restraint devices.

The documented hire date for Staff 1 was 07/20/2022. There was not a criminal history record check or a copy of a child abuse and neglect search from all of the states in which the individual had resided in the preceding five years available for review during the inspection. Staff 1 was observed working during the inspection.

8VAC20-780-510-L · Based on staff interviews and review of photographs, the center failed to ensure that medication, expect for those prescriptions designated otherwise by written physician?s order, including refrigerated medication and staff?s person medication, shall be kept in a locked place using a safe locking method that prevents access by children.

Evidence: Staff 1 stated that on 02/14/2023, Staff 3 sent a photograph via text message of a box of pills, containing 21 individual compartments full of pills, that was found on top of the refrigerator in the infant classroom. Staff 1 stated that the pill box belonged to Staff 2. The staff persons medication was not kept in a locked place to prevent access by children.
