The center did not request a search of the child abuse and neglect registry and the sex offender registry from one state for Staff #2, who had been employed for three weeks and was working with children at the time of the incident that occurred on 02/03/2026.

1. The center?s playground safety procedures state ?staff should be positioned in a way that there are no blind spots and that staff should circulate around to prevent blind spots from occurring.? The playground map for staff indicates there should be staff at each corner of the playground. The center did not follow its own procedures when video footage showed three staff in the middle of the playground with their backs to children playing at the top corner of the playground. Infant #2 (age 16 months) walked around that corner and was out of sight and sound of staff #1, staff #2, and staff #3 for less than a minute. 2. The center?s procedures for identifying where attending children are at all times states, ?Children will always be within actual sight and sound supervision of staff.? It also states that staff are to scan the room and count children, especially during transitions, when children are moving from one location to another. The center did not follow its own procedure when 1.) Infant #2 (age 16 months) was out of sight and sound supervision of staff #1, staff #2, and staff #3 for less than one minute and 2.) Staff #1 and staff #2 left Infant #1 (age 14 months) alone and unsupervised in the classroom for five minutes when the staff took the rest of the class outside. Staff #1 and staff #2 did not do a scan of the room or correct count of the children in their care.

In an infant room, staff #1 was sitting on the floor with a vape pen stored in the staff person's pocket. When the staff got up from the floor, the vape pen containing THC fell out of the staff's pocket onto the floor. The pen was accessible to infant #1 (age 12 months) who was within inches from the pen.

Staff #3's date of hire was 09/25/2023. The orientation certificate in the record was dated 01/08/2024. The training was required to be completed by 12/25/2023. 3. 8VAC20-780-500-B · Based on observation, the center failed to ensure that the diapering surface was cleaned with soap and water, and sanitized after each use.
Evidence: 1. In Classroom #3, Staff #1 was observed completing a diaper change. Staff #1 completed the diaper change and handwashing procedures. The Licensing Inspector had to ask if she were going to clean the diapering surface. Staff #1 sprayed bleach water on the surface and immediately wiped the surface dry. Staff #1 did not clean with soap and water first, and did not let the sanitizing agent air dry. 2. In Classroom #10, Staff #2 was observed completing a diaper change. Staff #2 sprayed the diapering surface with soap and water, and bleach spray at the same time. Staff #2 did not first clean the surface with soap and water and wipe dry.
