On October 24, 2025, Child A would not lay on their cot as directed by Staff A. Staff A then used prompts that Staff A knew Child A would not like in an attempt to get Child A to lay down. The prompts were not constructive in nature nor age and stage appropriate.

Evidence: On March 7, 2024, Staff #2 snatched a foam block from Child #1, three years old, and threw it over the playground fence. Child #1 retrieved another foam block, which Staff #1 attempted to take away. Child #1, holding onto the block, laid on the ground as Staff #1 wrestled the block from Child #1?s hand. Staff #1 looked at Staff #2 and loudly stated ?he needs his ass beat? and threw the block over the fence.

Evidence: 1. The first day of employment for Staff #5 was 9/1/2022. There were no results in the file, but a copy of the request that was notarized on 8/26/2022. 2. The Operations Manager followed up with HR and they stated they had not received the request. The request was resubmitted to HR on 10/26/2022 for entry in the portal.

Evidence: 1. On several occasions on March 30, 2022, Staff #1 pulled out an electronic smoking device and used it in front of other staff and children that were present. 2. Staff #1 admitted to the Executive Director that she had used an electronic smoking device. 3. While the facility has a no drug policy, it was updated to explicitly state that vaping is prohibited.
