    8VAC20-780-400-A · In order to promote the child's physical, intellectual, emotional, and social well

    being and growth, staff shall interact with the child to provide needed help, comfort, support and respect personal privacy. On Tuesday, May 12, 2026, Staff #1 did not respect the personal privacy of a child in their care when Staff #1 touched the child on the rear end. Staff #1 and Witness #1 confirmed that Staff #1 had touched the child on the rear end area following a jump roping accomplishment. Staff #1 stated that they gave the child a high five and then patted the child on the rear end area to congratulate the child on their jump rope accomplishment. Witness #1 stated that Staff #1 gave the child a high five and then smacked the child's rear end. Staff #1 and Witness #1 both described the touch to the rear end area as something you would see when congratulating a baseball player on a good play.
