Evidence: Interviews with staff #1, staff #2, staff #3, and staff #4 and review of video footage revealed that on July 17th, child #1 (age 5 years 5 months) was observed improperly riding a tricycle which caused child #1 to flip backwards and hit child #1's head on the chain link fence. Child #1 required a visit to the emergency room and received medical intervention. Observation and measurement of the tricycle revealed that it is approximately 10 inches in height. Documentation review of the manufacturers label revealed that the tricycle is designed for children ages 3 years to 4 years.
