Evidence: The center failed to follow their written policy for supervising outdoor play as demonstrated by the following incident: 1. The center's policy for playground safety and appropriate dress while on the playground states "Staff will ensure that children are wearing jackets, coats, mittens, gloves and/or hats, if needed." 2. On 12/21/20, the parent of child 1 (age 2 at the time of the incident) observed a picture on the center's web based application of his child outside on the playground with no coat on. The outside temperature that day was approximately 45 degrees. 3. Staff 1 admitted that she did not follow the center's playground safety policy on 12/21/20 by not helping child 1 put his coat back on after he had taken it off. 4. Staff 2 confirmed that staff 1 did not follow the center's policy on playground safety while outside with the children on 12/21/20.

1. Per the center?s supervision policy and procedures, children shall be supervised at all times and a 5 year old child was left alone and unsupervised in the school?s transportation vehicle. 2. Per the center?s transportation procedures, staff were to walk to the rear of the bus, looking for the children in under and around each seat. Staff did not check the rear of the bus which resulted in a child being left unsupervised in the school?s transportation vehicle for approximately 16 minutes.

Evidence: 1. On June 10, 2024, Staff #1 struck Child #1, age 22 months, with her hand on the child?s hand. 2. Staff #1 admitted to ?swatting? Child #1 on the hand and that she was ?from the old school? to both the Director and Lead Teacher in the classroom.

This poses as an injury hazard to the children in care. 2. Staff members confirmed that the cords were hanging and in reach of children.

Under the outdoor play equipment with moving parts and climbing apparatuses, the fall zone has no mulch in which the children are landing on soil. 3. Staff #1 confirmed that the mulch has dissipated and there is minimal to no resilient surface throughout the playground.

District Manager, Staff #3, confirmed watching the video footage from the morning of July 28, 2023, in which Child #1 was observed to clean up feces off the daycare floor. 3. Staff #2 has been terminated as Assistant Director as it is noted that they were observed being unprofessional and inappropriate by allowing a child to clean up another child?s feces. 4. Staff #4 confirmed seeing the feces on the floor and that Staff #2 confirmed to them that they had Child #1 clean up feces off the floor.
