8VAC20-780-340-A · Based on four interviews and review of documentation, the center failed to ensure the protection of one child when a heavy piece of unsecured equipment fell onto the child, breaking the child?s leg.

Evidence: 1. On 04/05/2021 at approximately 10:20a.m., Child #1 (age 2 years 6 months) was playing outside on the upper playground and was in the care of Staff #1 and Staff #2. Child #1 and another child were playing around a large chalkboard, approximately 4 feet by 4 feet in size, which was leaned up against the building. The other child knocked the chalkboard over and it fell onto the leg of Child #1. The weight of the chalkboard broke Child #1?s tibia and fibula in the lower right leg. 2. The written injury report was completed by Staff #1. She documented that the accident occurred at 10:20a.m. on 04/05/2021. 3. Interviews with Staff #1 on 04/12/2021 and 05/27/2021 revealed that while on the playground she saw Child #1 and other children playing near the chalkboard. She saw a child run behind the chalkboard causing it to fall over onto Child #1, knocking him down. She picked up the chalkboard and sat on the ground next to Child #1 to assess him. The child was upset and could not find his calm. She carried Child #1 inside and gave him to the director. She then went to get ice and call the child?s parent. 4. Staff #2 stated in an interview on 04/14/2021 that she was on the other side of the playground and did not see the chalkboard fall but saw that it had landed on Child #1. 5. An interview with the parent of Child #1 on 05/14/2021 revealed that Staff #1 called her and asked that she come to the center to get her child. Staff #1 told her that he had been hurt when a chalkboard fell onto his leg. The parent reported that the child had a broken tibia and fibula. 6. During an interview with the director on 04/12/2021, she reported that the chalkboard had not been secured to the building or the fence since the center had moved from the old school into the new building approximately a year prior. The director stated that the chalkboard was 4 feet by 4 feet in size.

8VAC20-780-340-A · Based on interviews and document review, the staff supervising children failed to always ensure their care, protection, and guidance.

Evidence: On 03/06/2024 Child 1, three years old, was standing on a library ladder, measuring 74 inches and located over a bare floor. The child was attempting to return a toy to a shelf located 78 1/2 inches above the floor. Although a staff person was standing next to him supervising the activity, the child fell to the ground, resulting in a left temporal bone fracture with pneumocephalus and a hematoma behind the child's left ear.

Nonprescription drugs and over-the counter skin products shall not be kept or used beyond the expiration date of the product. The center had three expired over-the-counter diaper ointments.

8VAC20-780-340-A · REPEAT VIOLATION When staff are supervising children, they shall always ensure their care, protection, and guidance.

On December 19, 2024, while diapering child #1 (age five months) staff #1, who knew child #1 could roll over, stepped away from the counter the child was lying on, while not looking at, nor touching the child, to talk to a staff member. Child #1 fell approximately 3 feet to the laminate floor hitting their head on a cushioned mat and body on the bare floor, resulting in the child crying and having a red mark on the child's back.

Evidence: 1. The record for staff 2, hire date 1/22/23, and staff 5, hire date 9/25/23, did not have documentation of completing the Virginia Department of Education-sponsored orientation course. 2. The director verified neither staff have completed the course.

Evidence: Staff 1 showed the licensing inspector the allergy list for downstairs was posted on the side of the cubbies in the hall. There was no cover over the list.

Evidence: 1. The record for Staff Member #1 contained a negative TB screening dated 02/07/2022. Date of hire and date of coming in contact with children was 01/13/2022. 2. The director verified the TB screening was after the date of hire and after coming in contact with children.
