Staff #1 also lifted infant #2, age 10 months, off the ground by one arm at the bicep and carried the infant by the one arm across the classroom. One of the infants cried as a result.

At approximately 9:45 a.m. in the preschool classroom, cereal, cranberries, and a cranberry wrapper were observed on the floor under the tables. At least two areas of spilled milk were observed on top of the table. 2. In the bathroom of the two's classroom, a potty chair was observed with a dried yellow substance all over the bottom on the inside.

SYSTEMIC VIOLATION Based on review of documentation, the center failed to request out of state background checks for any staff that has resided outside of Virginia in the last five years prior to employment. Evidence: Staff #3, date of hire 8/10/2024, had a New York state identification card issued in 2023 on file in the record. Staff interview revealed that the staff member had resided outside of the state of Virginia in the last five years. There was no out of state central registry or sex offender check on file. Staff #4, date of hire 7/30/2024, indicated out of state residence in Georgia on their central registry background check form in the last five years. There was no out of state central registry or sex offender check on file.

Evidence: In the two year old classroom,' 1. The toilet on the left of the bathroom was missing the lid to the water tank. The toilet on the right did not flush, had toilet paper remnants in the bowl and was inoperable. Staff interviews revealed they had been this way for approximately two weeks. 2. The floor was visibly soiled with debris and stains. The carpets were visibly soiled. There were dust and an active spider web in the bottom corner on the large cabinet in the far left of the classroom.
