Evidence: 1. Staff #2's sworn disclosure statement dated 03/31/2022 stated they had lived in two other states outside of Virginia within the last five years. 2. An out-of-state child abuse and neglect check was required to be sent out within 30 days of employment. There was not an out-of-state child abuse and neglect check completed for Staff #2. Date of hire for Staff #2 was 04/01/2022. An out-of-state child abuse and neglect check was required to be sent out by 05/01/2022. 3. Administration verified the date of employment for Staff #2 and that there was not an out-of-state child abuse and neglect check completed.

Staff #3 file contained a national background check dated 09/27/2021. Date of hire for staff #3 was 09/21/2021. 4. Administrator verified the date of hire for Staff #3 as 09/21/2021 and confirmed the date of 09/27/2021 for the national background check.

22VAC40-185-40-E · Based on documentation and interviews, the facility failed to follow their own policies and procedures for playground supervision.

Evidence: 1. On 02/18/2021, Staff #1 confirmed that he sent Child A outside on the playground beyond the outdoor classroom to collect materials and put them in a pile. Staff #1 stated that he got the child dressed for the cold, and watched the child through the window, and then Staff #1 became distracted. 2. The policy on supervision states, "Staff should always be aware and observant on the playground." 3. The Playground Supervision policy states, " The primary responsibility is to supervise the children and their activities."
