Behavioral guidance must be constructive in nature, age and stage appropriate, and must be intended to redirect children to appropriate behavior and resolve conflicts. On 11/10/2025, during the transition from lunch to nap time, Staff #1 was sweeping the floor when Child A (age 3) attempted to pick up and eat food from the floor. In response, Staff #1 strongly pulled the child upward by the collar of the shirt to prevent the child from accessing the food. This method of physical redirection was not constructive, age or stage appropriate, as it involved physically pulling the child by their clothing for behavioral guidance.

In the Ponies (2 to 3 years) classroom, a section of the wall border was missing at floor level, exposing chipped wood and drywall and the side panel of a shelf had peeling tape, both in areas accessible to children. In the Raccoons (18 months to 2 years) classroom, a mirror was secured with six pieces of peeling tape and an electrical outlet was covered with peeling masking tape, both in areas accessible to children.

On 06/13/2024, at approximately 8:50 a.m. (according to the video time stamp), Staff #1 and Staff #2 did not notice as 3 out of 9 children opened the door to the fitness room and exited unsupervised to the outdoor playground. 2. Staff #1 and Staff #2 confirmed they were unaware that the 3 children had left the room unsupervised until Staff #3 found the children alone. Staff #1 brought the children back to the fitness room. 3. Based on video footage, Staff #3 found the 3 children on the enclosed playground at approximately 8:52 a.m. (video time stamp). The children were left alone and unsupervised on the enclosed playground for approximately 1.5 minutes.

Evidence: 1. On 10/12/2023 at approximately 3:00pm, while the children were sitting at the table eating snack, Staff #1 ?smacked? Child #1 (14-month-old) on the side of his head by the ear when the child attempted to get up from their chair. When Child #2 (16-month-old) began to scoot his chair back to try and leave the table, Staff #1 stood behind the child, pushed him back into the table and ?smacked? Child #2 on the side of their head by the ear. 2. Child #1 was crying prior to the ?smack? and cried approximately 5 minutes longer after the "smack". When Child #2 was ?smacked?, his head was pushed to the side and he cried for approximately 2-3 minutes.?
