On 5/27/26 the center administration self reported that an incident had just taken place where a staff member had raised their voice and was animated while speaking to the child trying to get the child to calm down and to stop yelling. The behavior of the staff was not constructive redirection.

The files of staff #1 and #2 did not contain a tuberculosis screening. Both staff have been hired and actively working with the children for over a month.

A self-report, interviews, and review of documents determined staff #1 and #2 did not ensure the care, protection, and guidance of Child #1, 5 years old, when he exited the playground unsupervised on 6/25/24 at approximately 4:13pm and was found standing alone on the sidewalk in front of the building by parent at approximately 4:15pm. Staff #1 and #2 did not know the child had exited the playground until the child was returned to them by the assistant director.

Evidence: The record of staff #4, hire date 8/7/23, doesn't have a tuberculosis statement on file as required. This staff has been working with the children since hire. Tuberculosis statements are to be obtained at hire and before the staff comes in contact with the children.

8VAC20-780-340-A · Based on documentation and interviews the center failed to ensure the care, protection, and guidance of a child.

Evidence: Center staff were not aware that a two (2) year old child exited the classroom at approximately 4:15pm through the classroom door ,that leads outside, which opens onto the front outside area of the center. The child was found outside of the door in the grassy area, in front of the building, on 9/25/23. The child was witnessed to be alone by a parent who arrived to pick up his child at approximately 4:15pm. A few minutes later (approximately 4:18pm), upon exiting with his child, the two (2) year old was still alone outside in the same area. This parent brought the child inside to the office at this time. Staff realized the child was not visible within the classroom and were actively looking around the classroom when the child was brought into the center. The child was outside alone for approximately three (3) minutes.

8VAC20-780-40-E · Based on policy review and interviews, the licensee failed to ensure that the center?s activities services, and facilities are maintained in compliance with these standards, the center?s own policies and procedures that are required by these standards, and the terms of the current license issued by the department.

1. The KinderCare Education (KCE) employee handout on Child Abuse and Neglect Prevention and Reporting Guidelines states that as mandated reporters of suspected abuse or neglect, you are required to directly report to the local child protection agency or local law enforcement agency if you reasonably suspect a child had experienced abuse or neglect. KCE policy also requires you to immediately report your concerns to your manager, but this in addition to and not in lieu of your requirement to make a direct report to the local child protection agency or local law enforcement agency. 2. Child #1 reported to staff #1 an incident of suspected abuse. Staff #1 shared it with staff #3 who was I the classroom on the day of the reportable offense. Staff #1 and staff #3 reported the suspected abuse to staff #2 and did not report it to the local department of social services, per the center?s corporate policy. Neither staff #1, staff #2, nor staff #3 reported the suspected abuse to the local department of social services as per the center?s corporate policy.
