    The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department. The standards require the center to have a procedure to verify that all children have been removed from the vehicle at the conclusion of any trip. The center should have a list of names of the children being transported, The standards also required children under 10 years of age always shall be within sight and sound supervision. The center has a bus manual that states children must never be left unattended inside or outside of the Karter bus. It states a Karter bus may not depart from the Karter facility with one or more children on board without a Karter Attendance Log. Attendance must be checked each time Karter children board and exit the vehicle. The Karter Bus Driver or Team member must check the Karter bus, both inside and outside, after unloading all children by looking under and behind seats, under the bus, behind the bus, etc., to ensure that all passengers have exited. On 11/03/2025, Child #1 was left alone in the center's vehicle unattended for approximately 7-8 minutes. In interview, staff #1 acknowledged that she did not take attendance and she did not have an attendance log for child #1. Staff #1 stated she looked over her shoulder and did not check the bus inside to ensure all the passengers had exited. She acknowledged that she did not follow the policy and procedures of the bus manual. Administration confirmed the center did not have an attendance log for Child #1's transportation. The administration documented that Child #1 was left unsupervised in the vehicle for approximately 7 to 8 minutes before being located.

    On September 15, 2025, the daily student attendance record documented the Tokyo classroom being over ratio from approximately 9:02am until 4:08pm (youngest child 35 month old) with two staff supervising.(20 children until 2:14pm, 18 children until 4:08pm). On September 16, 2025, two staff were observed supervising 20 children in the Tokyo classroom (youngest child 35 month old) from approximately 10:50am until 1:00pm. The attendance record documented the classroom being over ratio from approximately 9:00am until 1:00pm. (20 children until 11:08am and then 19 children until 1:00pm).

On August 25, 2025, while sitting at a table a 2 year old child pushed their chair against the table causing them to fall backwards and hit the floor. The child became visibly upset. Three staff were working in the classroom and did not provide care, protection or guidance to the child. All three staff stated they did not see the child fall.

The center's discipline policies including acceptable and unacceptable discipline measures titled "Forbidden Actions and Behavior Policy" states "never use physical punishment, striking a child, roughly handling or shaking a child for any reason at any time." It also states "If a team member witnesses such violations, they must document and report them to the Director." Staff #1 roughly handled Child A (16 month old) on 7/10/2025 and the actions were observed by Staff #2. Staff #2 did not report these actions to the Director and did not document the incident.

The center's policy regarding medication states "Karter will administer over-the-counter medications at the request of the parent/guardian in accordance with VDSS. The parent/guardian is responsible for supplying the over-the-counter medication as well as completing and submitting a VDSS 'Medication Authorization Form'." The center did not follow this policy on January 14, 2025 when Medication #1 was administered to two year old Child #1 without receiving a request to do so from the parent/guardian and without a completed medication authorization form from the parent/guardian. Medication #1 belonged to the center and was not supplied by the parent/guardian.

    8VAC20-780-40-E · Based on documentation review, observation of video footage recording and interviews, the center did not ensure that the center's activities and services were maintained in compliance with these standards and the center's own policies and procedures that are required by these standards.

    Evidence: 1. The center's policy on playground and supervision states: "Team members should be involved with children, observing them at play and guiding them toward productive activities. Ninety (90) percent of all accidents in preschools happen on playgrounds, so active supervision of children is a must. Please do not congregate in groups with other teachers and chat. Observe the "triangle rule" and maintain stations amongst the children to ensure their safety . Chairs are not allowed outside. In order to maintain maximum supervision, sitting is not allowed.? 2. On 7/22/2024 at approximately 4:10pm two children (ages 4 and 5 years) were observed physically fighting and wrestling on the ground of the soccer field for approximately 1 minute and 20 seconds. The three staff on the playground and responsible for supervising the group of 20 children were unaware of the incident until the parent of one of the children arrived on the playground and intervened by yelling. 3. Staff #1 was observed sitting on the playground speaking with three children. She stated she did not see the incident. 4. Staff #2 was observed with her back to the children while speaking with a parent for approximately 5 minutes. She stated that she also did not see the incident. 5. Staff #3 was observed looking at Staff #2 speaking to the parent, then looking to the right, speaking with a child and then looking in the middle area of the playground. Staff #3 was standing directly across from where the children were fighting/wrestling and did not intervene to stop the children from fighting. She stated she did not see the incident until she suddenly heard the parent state ?Oh no, don?t hit my son.? 6.The three staff responsible for the 20 children were not observing the triangle rule and maintaining the stations amongst the children. All three staff were spread out in one line. Staff #3 should have been positioned across the field in the middle near where the incident occurred..
