8VAC20-780-40-E · The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
The staff handbook includes the center's discipline policies including acceptable and unacceptable discipline measures and states that teachers use positive redirection, role modeling and role play and teaching strategies for behavioral guidance and redirection. It also states that forbidden actions are not allowed including corporal punishment, verbal abuse of any kind, physical actions that cross the line, grabbing and pulling or restraining improperly, forcing compliance physically or any action that could be perceived as aggressive. On April 7, 2026, Staff #1 grabbed Child #1 (age 3) in the classroom and put the child in timeout in a chair for approximately 4 to 5 minutes when the child did not clean up. Child #1 got up from the chair and Staff #1 pushed her back down with two hands when the child did not choose to sit with Staff #2 or sit with Staff #1. Staff #1 grabbed Child #1 by the wrist and dragged the child back to the table to the child's seat when the child kept getting up from the table. Staff #1 grabbed Child #1 (Age 3) by the left arm and dragged the child across the classroom with the child's feet off the ground. The child hits a shelf while being dragged back to the other side of the classroom. Staff #1 then places the child on the floor to clean up their toys. Staff #1 grabs Child #1 by their right arm and drags the child and then forcefully puts the child in a chair. Staff #1 ran after Child #1 (age 3) on the playground and grabbed the child by the neck and arm and then readjusted and grabbed under the child?s arm and lifted the child off the ground and started dragging Child #1 approximately 10 feet up the hill and made the child sit down.
