8VAC20-800-120-A · Providers must maintain a record for each caregiver that shall contain the following:

Verification of age, job title, date of employment or volunteering, name address and telephone number of a person to be notified in an emergency, documentation of the education and training required. The provider did not ensure that all individuals working with children are qualified caregivers. On May 15, 2026 Household Member #1 was utilized as an assistant caregiver in in the family day home. Household Member #1 is not an identified assistant and does not have a record that contains all of the requirements of a family day home assistant caregiver. The provider was out of compliance on for approximately 3 hours.

8VAC20-800-170-B · The provider shall obtain from each caregiver at the time of hire and each

prior to coming into contact with children a current Report Tuberculosis Screening form published by the Virginia Department of Health or a form consistent with it documenting the absence of tuberculosis in a communicable form. The form shall have been completed within the last 30 days and be signed by a physician, physicians' designee, or an official of the local health department The provider did not ensure that the Tuberculosis Results were completed within the last 30 days prior to hire for Staff #1 and Staff #2. Staff #1 Tuberculosis Results were completed approximately 3 months too early and Staff #2 Tuberculosis Results were completed approximately 1 year too early.

8VAC20-800-180-A · The provider shall obtain for each caregiver and adult household member a current Report of Tuberculosis Screening form, every two years from the date of the first screening or more frequently as recommended by a physician or the local health department

The provider did not ensure that each caregiver and adult household member has a current report of Tuberculosis Screening every two years from the date of the first screening. Staff #2 last documented screening was dated September 18 2023 and Household Member #1 last documented screening was dated September 20 2023.

22.1-289.057-A · The program is required to submit to VDH and implement a plan to test potable water for lead.

The program did not have evidence of a testing plan submitted to VDH and/or the program did not have evidence of the implementation of the required testing plan. The provider is 5 months out of compliance.

8VAC20-800-120-B · Assistants' records shall contain name address and telephone number of a person to be notified in an emergency and documentation that two or more references as to character and reputation as well as competency were checked before employment.

Staff # 3 record does not contain documentation that references were checked and who to notify in case of emergency; including telephone number and address.

8VAC20-770-60-C-2 · Based on a review of staff records, a new staff member did not have a central registry search completed within 30 days of employment.

Evidence: Staff 3 did not have a completed central registry search on file. The home has documentation that it was mailed November 2023, but follow ups were not documented and the background search remains incomplete.

22.1-289.036-B-2 · Based on a review of caregiver and household member records, the provider failed to obtain a current Criminal History Record.

Evidence: -Caregiver #1's record does not contain documentation of a current Criminal History Record. The last Criminal History Record expired 02/16.2023. -Household Member #1's record does not contain documentation of a current Criminal History Record. The last Criminal History Record expired 02/26/2023.

8VAC20-800-780-B · Based on review of children's records, the provider did not annually review with the parent the emergency contact information (as required in 8VAC20-800-60-B).

Evidence: Child #1's record did not contain documentation of an annual review. The last review date for emergency information was 06/14/2022.

22.1-289.036-B-4 · Based on a review of caregiver records, the Family Day Home failed to obtain a copy of the required Central Registry background check.

Evidence: Caregiver #2's records do not have documentation of Central Registry background check.
