In order to promote the child's physical, intellectual, emotional, and social well-being and growth, staff shall interact with children to provide needed help, comfort and support. Multiple staff interviewed reported that they had observed Staff #9 speaking to children with a strong tone of voice. Staff described the tone as sometimes aggressive and yelling. Sometimes the strong tone of voice was directed at the entire class and sometimes is was directed to an individual child. On at least one occasion the tone of voice directed at one child resulted in the child crying.

On 11/5/25, from approximately 8:24am-8:44am, the 3-year-old preschool class exceeded a 1:10 ratio. At 8:24am, the ratios in the classroom were 1:11; at 8:30am, the ratios in the classroom were 1:15; at 8:35am the ratios in the classroom were 2:22; and at 8:40am, the ratios in the classroom were 2:24. Staff #1 and #2 did not alert management that they/the class was out of ratio for this period of time. At 8:44am, Staff #3 clocked into work and it is estimated that they arrived in the classroom by 8:45am.

8VAC20-780-40-E · The operational responsibilities of the licensee shall include ensuring that the center's activities and services are maintained in compliance with these standards, and the center's own policies and procedures that are required by these standards.
The center's written minor injury policy states that first aid shall include the washing, applying of antibiotic ointment and covering with a bandage for scratches, cuts and abrasions. The written injury report documented the washing of the child's knee abrasions, but no additional first aid was provided to the knee abrasions. The center's written minor injury policy states that ice will be applied to bumps/bruises. The first injury report, written 9/26/25, documented that ice was offered but the child refused the ice. The second report, written 10/1/25, documented that while the child declined ice, it was later applied when staff noticed a bump forming on the child's forehead. The center's written serious injury policy has provisions for concussions, which is not known to have occurred however, there is no documentation of staff having been trained to assess a child for concussions. The child did receive what is considered to be a potential serious injury, a head injury, when they were pushed to the ground causing their head to hit the blacktop and a bump to form on the forehead area. The center's written serious injury policy includes notification of the parent as to the extent of the injury and informing the parent it is their decision whether to pick up the child, or have the center call 911. On 9/26/25, the parents of Child #1 were not notified of the potential serious injury until they arrived to pick up the child approximately 32 minutes later. At that time, the verbal and written accounts of the injury were not accurately communicated to the parent. The parent later learned the cause of the accident from the child.

On 1/15/25, Child #3 fell during a dance activity after bumping into another child. There were 3 staff present at the time of the accident and all staff stated they did not inquire to see why the child was crying or what hurt and acknowledged they did not provide first aid to the child. Child #3 was picked up 19 minutes after the accident at which time staff provided the parent with an incomplete verbal accounting of the accident. The parent observed the child crying and not being able to put any weight on the wrist and called back to the center for additional details, as a written injury report was not provided to the parent at pickup. The child's injury required outside medical care.

Evidence: 1. On 8/21/23, in the Preschool-2 classroom, Child #4 was placed on a cot in the cubby closet which also serves as a pass-thru entrance/exit to a bathroom. This area is a small confined space for a cot and simultaneous safe access to cubbies and the bathroom. 2. On 8/30/23, in the Preschool-2 classroom, Child #3 was placed on a cot in the cubby closet and as a result other children were unable to access their cots and were climbing onto a low-level cubby shelf and sliding across to their respective cubbies, with belongings in their hands, while additional children were made to step around the cot with minimal space to safely enter/exit the bathroom. 3. On 8/30/23, paper trash and food were observed on the floor in the Preschool-1 classroom. The inspector observed pumpkin seeds scattered on the rugs and was told that the seeds were from the breakfast served the day prior on 8/29/23. [Note: Children from multiple classrooms arriving prior to 8:30am combine in the Preschool-1 room.]
