Based on information obtained from interviews with the operations staff, the victim?s parent and oberservations from video footage it was determined that a caregiver was observed rejecting a child by knocking their the water bottle from their hand and making the child go away when the child approached the caregiver after the child accidentally hit another child with their water bottle.

The standard was evaluated as part of an investigation and was found deficient. Based on information gathered and observations, it was determined that the operation was not following the meal patterns established by the U.S. Department of Agriculture (USDA) Child and Adult Care Food Program (CACFP) that is administered by the Texas Department of Agriculture. One child allergic to a fruit being served for lunch and snack was not provided an alternative food at lunch or an afternoon snack.
