Observation- On March 1, 2023 LC Clark and LC Rogers conducted an unannounced complaint investigation visit and observed the agency did not have adequate staff for the children present during the early morning hours which resulted in a grouping violation when a 22 month old child arrived and was grouped with children over 30 months (32 and 34 months). 1240-04-01-.22 SPECIFIC REQUIREMENTS FOR CHILD CARE CENTERS. (1) Required Adult:Child Ratios. (a) Adult:child ratios in this paragraph shall be maintained by the child care agency while the children are on the premises of the child care agency, including outdoors or on the playground. Licensing Consultant (LC) Clark conducted a safety plan monitoring visit for a safety plan in place at the agency. Supervision logs were maintained for individuals on safety plans. Agency understands that the safety plan is in place until a lift letter is received from DHS Licensing. Check Sheet reviewed with Director. The visit conducted today included monitoring the agency's compliance with Licensing Rules and Regulations. LC monitored the following areas – Health and Safety, Specific Requirements for Child Care Centers, Food and Food Service. LC conducted a follow-up visit, safety plan monitoring visit was conducted along with Safety Plan Lift Letter Served. Other Monitoring/ Observations: Observation: On March 1, 2023, Child Care Licensing received a complaint, and an investigation was initiated. A Safety Plan was implemented during the investigative period; the DCS complaint was screened out, and TDHS did not find any evidence to substantiate the allegation therefore the safety plan will be lifted effective 3-6-2023, the Safety Plan Lift Letter will be emailed to the agency for their records. The Safety Plan supervision log was reviewed on 3-6-2023 and found to be in compliance. Violations noted on 3-1-2023, require a follow-up visit, the follow-up visit conducted on 3-6-2023 found the agency in compliance with adequate staff to meet the ratio requirements. The complaint investigation is complete, violations cited on 3-1-2023 were immediately corrected and a follow-up visit conducted on 3-6-2023 was made to ensure compliance. All allegations of the complaint were investigated with violations cited for valid complaint issues. A Put on Notice letter was delivered via email on 3-3-2023. The agency has printed and posted the Put on Notice letter which will be posted for 60 days, parent signatures are being obtained, the agency has 14 days to return the completed parent signature page to TDHS. Technical Assistance: LC Clark discussed and has worked with the owner on the plans of corrective actions for the violations cited on 3-1-2023. The owner is submitting Plans of Corrective Action in the eLicensing portal. LC will be available to assist if questions or issues arise while completing the plans of corrective action. LC discussed with the owner reviewing attendance trends and the owner is monitoring staffing patterns and attendance trends to ensure ratios are maintained. CCR&R is available to assist as well as LC. No Violations noted.

LC Clark recommends having parents/guardians sign the notice to confirm that parents/guardians understand to prevent another grouping and/or ratio violation in the future. LC Clark suggests that each age group has an educator in the early morning hours to ensure groupings and ratios are maintained. Both educators and management need to be aware of groupings and ratios to maintain compliance. TAM Referral submitted to Child Care Resource and Referral (CCR&R) for targeted technical assistance for Administration and Professional Leadership – Staffing Patterns and Health and Safety Specific – Behavioral Management. Summary of Complaint investigation visit. The visit conducted today included monitoring of the Agency's compliance with Licensing Rules and Regulations along with complaint investigation PCS1002262. Technical Assistance Given: Educators are aware of safe sleep procedures and follow procedures. Educators asked about children falling asleep while the educator is providing care for another infant when one educator is only available and LC suggested finding a time to safely stop caregiving duties to place the sleeping child in a crib if the child falls asleep while in a bouncy or on the floor. If at all possible call for extra help to assist if a child falls asleep. The educator could also document on the nap log that child fell asleep in bouncy / floor and was moved to crib after 1 minute. The complaint found to be invalid. Violations Received: None

LC Clark also completed a complaint investigation. All complaint issues were investigated. The visit also included a review of the QRIS. Technical Assistance Provided: 1. 1240-04-01-.18 Emergency Preparedness – During today's visit, LC Clark discussed Emergency Preparedness Plan and reviewed 1240-04-01-.18 with Director Green. LC Clark suggested that the agency send the Emergency Preparedness Plan via email so that revisions to the EPP can be made including completing all fields on pages 11-15. LC discussed what to note on these pages. 1240-04-01-.18 Emergency Preparedness. A template will be sent via email to use and reference. 2.
