LC monitored the following areas – Supervision, High Risk, Record Keeping, Ownership, Organization, and Administration. Monitoring / Observations: LC conducted interviews with the Director and Educator in Four Year Old classroom. LC obtained a copy of the agency's parent handbook, text messages with the Director and former staff member, and behavior reports. LC determined that this complaint was invalid and no violations were cited.

Unannounced Complaint Investigation - The visit conducted today included monitoring the agency's compliance with Licensing Rules and Regulations. LC monitored the following areas – Supervision, High Risk and Incident Reporting, and Record Keeping. Monitoring / Observations: LC conducted interviews with Director and agency staff. LC obtained a copy of the termination letter for one staff member, the disciplinary forms, and the child's incident report. LC determined that this complaint was valid and a violation was cited - see below and safety plans were served on two educators. Technical Assistance: LC discussed playground supervision and roll call with each educator in the classrooms. LC discussed the licensing rules of the minimum four times per playground visit that roll call must be completed and LC suggested that the agency add more roll calls to be completed at each doorway or transition area since this lapse occurred in one of those areas. LC discussed that epi-pens must be stored inaccessible to the children at all times. The epi-pen was moved to a higher location in the classroom. The following VIOLATIONS were cited: Violation #1 - 1240-04-01-.11 SUPERVISION. (2) Supervision Procedures. (a) To ensure the health and safety of all children enrolled, the management of the child care agency shall maintain a system that enables all children to receive a level of supervision that is appropriate to their age and their developmental, physical and mental status. The child care agency staff shall be within sight and sound of the children in their care at all times, be aware of their activities and be able to intervene appropriately. Observations: On August 7, 2023 Agency Director self-reported that a 20-month-old child was left unattended in the hallway for about 45 seconds as the children transitioned from the playground back to the classroom. LC served two educators' supervision safety plans. LC discussed the supervision log with the Director and the requirements of the safety plans. The agency self-reported that a 20-month-old child was left unattended in the hallway for about 45 seconds.

The visit conducted today included monitoring the agency's compliance with Licensing Rules and Regulations. LC monitored the following areas – High-Risk areas, Supervision, and Incident Reporting. LC conducted a major violation follow-up visit to hand deliver the Put On Notice Letter and conduct a safety plan monitoring visit. LC reviewed and revised the check sheet from 03/23/2023 and LC discussed it with Director Throckmorton. LC emailed the revised check sheet to the Director. On March 22, 2023, Child Care Licensing received a complaint, and an investigation was initiated. Eight Safety Plans were implemented on 03/23/2023 during the investigative period; the DCS referral was screened out. The Safety Plan supervision logs were reviewed on this date, 03/27/2023, and were found to be in compliance. Violations noted on 03/23/2023, require a follow-up visit, the follow-up visit was conducted on 03/27/2023. LC hand delivered and discussed that the agency must print and post the Put on Notice letter. This formal notice must be posted for sixty (60) calendar days in a clearly visible location in the agency and parent/guardian signatures must be obtained to indicate they have read this document. The parent signatures must be submitted to this Department within fourteen (14) calendar days of the date of this letter. LC reviewed the Put on Notice Letter and Parent Signature sheet with Director Throckmorton. LC discussed that parent signatures must be received within 14 days of this date. LC emailed these documents to the Director. LC discussed that incident reports must be completed and discussed with the parent of the child and obtain the parent's signatures for each of the three incidents and send the completed reports to LC. LC reviewed safety plan supervision logs for staff and found them in compliance. LC suggested that the agency use one page per person each day to document the supervision. Director had added additional supervising staff to each of the seven safety plans and emailed those updates to LC. LC and FS discussed with Director to reach out to the fire marshal regarding alarms on the doors or barriers in the hallway in the gym prior to making any changes. LC and FS discussed maximum group sizes and ensure that these are being followed when groups are combined. LC and FS discussed that the agency will need to complete the eight plans of corrective action in the e-licensing system. LC and FS discussed that the agency will need to notify LC if the agency needs to combine classrooms for prior approval. LC will make a TAM referral to CCR&R regarding the agency safety plans. FS discussed that once clarification is received regarding combing toddlers LC will inform the agency. No Violations noted.

LC reviewed agency staff files. LC reviewed the children's files. LC determined that this complaint was valid and violations were cited - see below and safety plans were served to the agency and seven educators. Technical Assistance: Groups of toddlers were discussed and LC will wait for the Regional Manager's response on citing that violation and this could occur during the next visit. However, LC did discuss that toddler groups can not be combined at any time. LC discussed that the agency must notify Department when the agency or classrooms are going to be closed. Three and Four-year-old classrooms are closed on March 23 and March 24 due to sickness. LC discussed that the agency must notify the department when serious incidents occur at the agency and complete incident reports to notify the parents. The following VIOLATIONS were cited: 1240-04-01-.06 STAFF. (1) Responsibility for Staff. (a) Owners, directors, and primary educators shall be responsible for: 1. Selecting qualified and capable staff; 2. The supervision, training, and evaluation and performance management of the staff; 3. The efficient operation of the child care agency's program; and 4. Providing written policy to staff that includes job functions, qualifications, lines of authority, staff performance evaluations, and disciplinary process. Observations: Management Staff did not notify the department of the lapses in supervision at the agency. (15) Falsification of any information or documentation is prohibited. Observations: On March 23, 2023, in the process of beginning the investigation of this complaint, LC Phillips questioned the Assistant Director, who was in charge during the absence of the Director, if the agency has had any supervision lapses. Assistant Director stated no and informed LC Phillips that she was calling Director. Once Director was on the phone LC was informed by Director that the agency had not received any complaints from parents, teachers, or anyone. Both the Assistant Director and Director informed LC Phillips that neither was aware of any lapses in supervision. Disciplinary reports that were provided to LC Phillips reflected that both the Director and the Assistant Director had knowledge of the supervision lapses as indicated by their signatures on all of the disciplinary action forms. LC served seven educators' supervision safety plans. LC also served the agency with an agency training safety plan. LC discussed the supervision log with the Assistant Director and the requirements of the safety plans. Assistant Director will obtain the signatures on the safety plans of all other staff members upon their return to the agency. LC will email all safety plans and check sheet to the agency. Revisions were made to the check sheet and revisions were discussed with Director during the visit on 03/27/2023. Another violation was added to the check sheet and Regional Manager discussed this violation with the Director via telephone call and email on 03/31/2023.
