There were five children observed in the 3-4 year old classroom unsupervised. until the director arrived at 8:49 am. The classroom's educator arrived at 9:05 am.

    Rule: 1240-04-01-.22 SPECIFIC REQUIREMENTS FOR CHILD CARE CENTERS. (1) Required Adult:Child Ratios. (a) Adult:child ratios in this paragraph shall be maintained by the child care agency while the children are on the premises of the child care agency, including outdoors or on the playground. (h) Naptime Supervision and Requirements for Naptime and Nighttime Care. 1. At naptime and during nighttime care, after the children have settled down, adult:child ratios for ages thirty-one (31) months and above may be reduced by fifty percent (50%) in each classroom as long as the children are adequately protected, and all of the following requirements are met: (i) At least one (1) adult educator shall be awake and supervising the children in each nap room/sleeping area; (ii) There are enough adults on the premises so that the adult:child ratio required for children when they are awake shall be met immediately. (iii) Ratios for children six (6) weeks through thirty (30) months shall be maintained. Observation: The Licensing Consultant arrived at 11:49 am to the center and while waiting outside in her parked vehicle, observed the Infant Educator driving up and entering the building. At 12:09 pm, the Licensing Consultant entered the center and observed four (4) separate classrooms with children napping in each. There was a total of 21 children and 3 educators present. The School Age classroom had 6 children present, but no Educator was present in the room. The 3–4-year-old Educator stated that the School Age Educator was on break and would return. The School Age educator arrived to the center by car at 12:25 pm. The Director/School Age Educator stated that the four staff present take lunch breaks two at a time during the children’s nap time. Adult:Child ratios during naptime should be maintained and at least one adult should be present in each classroom.
