0520-12-01-.06 PROGRAM OPERATION. (i) Staff shall position themselves strategically for adequate supervision and quick response. 0520-12-01-.09 PROGRAM. (1) Educational activities shall be based on developmentally appropriate educational practices. (d) Staff shall plan ahead for developmentally appropriate activities and written lesson plans shall be provided for children of each age group. (c) Discipline shall not be related to food, rest, or toileting. 0520-12-01-.14 CARE OF CHILDREN WITH SPECIAL NEEDS (l) The use of physical holding restraint in the following circumstances is not prohibited: 1. The brief holding by an adult in order to calm or comfort; 2. The minimum contact necessary to physically escort a student from one area to another; 3. Assisting a student in completing a task or response if the student does not resist, or resistance is minimal in intensity or duration; or 4. Holding a student for a brief time in order to prevent any impulsive behavior that threatens the student’s immediate safety. On the date listed above CCPE Williams conducted an unannounced visit to the program and found the following discrepancies regarding a child’s safety in accordance to the rules in this Chapter. One little boy while walking to lunch became agitated. When he reached the cafeteria at the lunch bench he began banning his head on the bench. The assistant teachers were just sitting yelling his name not to do that. After 3 bangs the lead teacher the teacher finally brought his helmet and placed it on his head. A lunch room monitor proceeds to tell the child “if you don’t stop you won’t get your yogurt.” The monitor proceeded to say “he know what to do when you talk about taking his food” and the assistant laugh and continue to sit at the table as the child hit his bare head on the lunchroom table bench (the part used for sitting). Once the helmet was on his head the child proceeded to bang his head on the bench even more violently. After about 5 violent bangs (making the entire table shake) the Pre-K teacher and I began to become more alarmed to the point we reached for the child. The bangs from the helmet to the table were so violent that his head would bounce back like a bouncing ball and the table trembled with force. I asked the TA’s if there something they could do to assist him and their reply was “he does that.” Basically, no one moved to help the child other than myself and the Pre-K teacher (non-Functional skills class). I look around for the teacher and she is nowhere in sight. The TA said she walking with another student that does not feel good. I get to the room she is changing the child and walking around the class (not sure what she is looking for) however, her assistance was desperately needed with the little boy and the TA could have handled toileting at that time. The behavior continued after lunch as the teacher placed the students on the carpet with storybooks and walked back into the adjourning room (closed door) to gather materials for a project she planned to do during the observation. The assistant teachers continued to sit at the table with their backs to the children and discuss personal matters. One TA was cutting out art paper for the activity with her back to the children as both teachers continue their conversation about personal issues (i.e. new apartment, finishing a master’s degree, and the second TA stating “the Lord teaching me a lesson because I want to shoot off). Finally, the teacher emerge from the room with an art activity for the children. Other language observed and told to the children were “STOP, don’t get him started” referring to the child. “STOP” “Look at this girl, she has her shoe off again laughing (this is the same child that had her shoes and socks off with her feet resting on the table where the teacher assistant was sitting when I started the observation). Before the observation, I always look briefly through the classroom door window to get an undisturbed view, but once I walked in the teachers began to put the child’s shoes back on. I am advising additional training with the Special Educational Consultant, on Developmentally Appropriate Practice and Supervision Training regarding students with potentially harmful behaviors due to their disability.
