(a) All records required by this chapter shall be maintained in an organized manner onsite, in a centralized location, or available electronically, and made readily available upon Department request. (2) General Children's Records. (a) The childcare agency shall maintain a file for each child in a central location within the childcare agency. (b) A child's records shall be kept for one (1) year following the child's leaving the childcare agency; however, the health record shall be returned to the parent/guardian upon request when the child leaves the childcare agency.

During an announced visit on 8/29/2024, the licensing consultant (LC) observed an educator present in the Infant/Toddler Classroom (6 – 13 months old) who had not received criminal background clearance prior to working with children. The LC discovered that the classroom was out of ratio. The ratio for the Infant/Toddler room is 1:5 (multi-age grouping chart) with a maximum of 10 children. This class had 11 infants and 2 educators present (1 educator cannot be counted in the ratio because her background had not cleared).
