Summary of Complaint Visit The visit conducted today included monitoring of the agency's compliance with Licensing Rules and Regulations and a complaint visit]. Technical Assistance Provided: 1. Recommended that the provider never burn candles as it is a fire hazard. 2. Recommended covering open outlets and items labeled keep out of reach of children be locked away when not in use. 3. Recommended that children not sleep on stacked cots and provide children aged one and older with a mat or cot for a nap. If any violations were received, details can be observed in the compliance details section of the visit along with corresponding corrective action plans. Provider admitted to burning candles in the classrooms sometimes. Toddlers were observed sleeping in pack-and-plays in the infant room. A two-year-old was observed sleeping on stacked cots in the two-year-old classroom. There were uncovered outlets observed by the LC in both the 2-year-old and 4-year-old classrooms. Nap checks, diapering, and feeding schedules were not documented in the infant /toddler classroom. The infant classroom was observed to be out of ratio.

Summary of Complaint Investigation Visit The visit conducted today included monitoring of the agency's compliance with Licensing Rules and Regulations. Technical Assistance Provided: 1. Notify of incidents and fill out incident reports immediately. 2. Have extra staff during meal times. 3. Have employeed staff with children in attendance sign in and out. Violations were received and include: 1. 1240-04-01-.11 SUPERVISION. 2.1240-04-01-.08 RECORD KEEPING. 3. 1240-04-01-.09 INCIDENT REPORTING. Correct Action Plan (CAP) completed. The parent's signature and time in and out were not written on the sign in and out sheet. Director did not report serious incident as required. Two children walked out of classroom door to outside while educator had her back to them, preparing lunch.

See Below for Detailed Information Observation: During assessment, educators were observed not consistently washing their hands before and after bottle feedings in the infant classroom. Rule 4: 1240-04-01-.13 FOOD AND FOOD SERVICE. (1) Meal and Snack Time Procedures. (a) Staff shall wash their hands with soap and water before preparing and serving meals and after meals and snacks. Children shall wash their hands with soap and water before and after meals and snacks. Compliance Statement: To ensure compliance, staff will wash their hands before and after bottle feedings in the infant classroom. Observation: During Assessment, children were observed left crying in cribs or bouncy seats during long periods of time and educators did not respond in a timely manner. Rule 3: 1240-04-01-.15 PROGRAM, LANGUAGE, AND LITERACY DEVELOPMENT (1) Schedule and Routines. (g) The educator(s) shall give individual attention to each child throughout the day to include the following activities: 1. For infants/toddlers: (v) The educator shall be attuned to child’s needs and respond. Compliance Statement: To ensure compliance, educators will be attuned to the child’s needs and respond. Observation: During assessment, the protective surfacing of pea gravel measurement was 3 to 5 1/2 inches. Rule 5: 1240-04-01-.14 EQUIPMENT FOR CHILDREN (3) Outdoor Play Equipment. (f) Climbers and swings shall have a protective fall zone surface recognized by the Consumer Product Safety Commission (CPSC) as a shock absorbing, resilient material maintained with a minimum average depth of six (6) inches. Compliance Statement: To ensure compliance, agency will have appropriate protective surfacing of pea gravel measurement of 6 inches. Observation: During assessment, infants were observed being confined in bouncy seats, cribs, or held for much of the day. Infants did not have access to developmentally appropriate equipment. Rule 7: 1240-04-01-.14 EQUIPMENT FOR CHILDREN (2) Indoor Equipment. (a) Sufficient indoor equipment, materials, and toys shall be available to: 2. Provide a variety of developmentally appropriate equipment so that each child may choose from at least two play options. Compliance Statement: To ensure compliance, Infants will have access to at least two play options that are developmentally appropriate. Observation: During Assessment, children were observed only receiving 45 minutes of outdoor play. Schedule observed stated that outdoor play occurs for 45 minutes. Rule 2: 1240-04-01-.15 PROGRAM, LANGUAGE, AND LITERACY DEVELOPMENT (3) Outdoor Play and Playground Routines. b) Outdoor play and moderate to vigorous indoor or outdoor physical activity shall be available as follows: 2. Toddlers and preschoolers shall have sixty (60) to ninety (90) minutes of outdoor play per day. Compliance Statement: To ensure compliance, agency will have sixty (60) to ninety (90) minutes of outdoor play. This will also be reflected on the daily schedule.

Rule: 1240-04-01-.11 Supervision (1) Supervision Procedures (e) Sign-In/Sign-Out Procedures. 1. Child care agencies shall maintain a daily sign-in and sign-out sheet that includes: (i) Each child’s printed full name; (ii) Date; (iii) Time of entry; (iv) Time of departure; and (v) Space for printed name and signature of parent/guardian or authorized representative Compliance Statement: All children must be signed in and out each day by a parent/guardian. Parent/Guardian must sign using their full name. Observation #2: PE checked new staff files and found a new employee; Gabbriel Midkiff only had 1 reference in her staff file. Rule: 1240-04-01-.08 Record Keeping 1.) General Record Keeping 3. Staff Record Requirements c.) Staff records shall include the following: 6.) At least 3 references Compliance Statement: All staff must provide the agency with at least 3 references. Observation #3: The agency did not have a current report card posted but had one posted from 2016. Rule: 1240-04-01-.05 Ownership, Organization, & Administration 12.) Posting Requirements (a) The following shall be posted near the main entrance where staff, parents, and others may view them: 2. Current child care agency Report Card Compliance Statement: All child care agencies must post their most current report card scores. Observation #4: The agency did not have their child care license posted and was not able to locate the license. Rule: 1240-04-01-.05 Ownership, Organization, & Administration 12.) Posting Requirements (a) The following shall be posted near the main entrance where staff, parents, and others may view them: 1. The child care agency license Compliance Statement: All child care agencies must post their current license. Rule: 1240-04-01-08 Record Keeping 1.) General Record Keeping e.) Immunization Record Requirement 1.) The child care agency shall have a Tennessee Department of Health Official Immunization Certificate before accepting any child age 2 months or older. Observation #1: An infant who turned 9 weeks old this week was enrolled this week without immunization records. Compliance Statement: The agency must receive the immunization record on any child prior to enrollment.
