Instead, the executive director, reported to LC Fain that the director rescinded her resignation when LC Fain inquired if the director was still the agency's director. He stated she had been on leave and would be returning once she went to the doctor. On 1/11/2024 date, the director reported to LC Fain and FS2 Middleton that the executive director had asked her to return to the role, but she has not communicated with him since submitting her resignation. To date, he has not submitted the name and qualifications of an interim director for Department review and is not permitted to serve in that role but has been doing so in the director's absence. However, during a complaint investigation conducted on 1/8/2024 date, all staff interviewed by LC Fain and LC Cook reported that the Owner/Executive Director was the person in charge at the agency and was not aware of the appropriate lines of authority at the agency. Director advised DHS Child Care Licensing Consultant Laura Fain by email on 1/3/2024 date that the reason for her resignation was due to Mr. Wimbley not allowing her to perform the role of site director without his interference and detailed that he re-routed all agency calls to his cell phone instead of allowing her to address parent concerns or questions.

(7) Safe Sleep Supervision Procedures. The educator did not complete a fifteen-minute physical touch on infants while they slept in their crib which is required. 1240-04-01-.15 PROGRAM, LANGUAGE, AND LITERACY DEVELOPMENT. (j) Children shall not be kept in restraining devices such as swings and high chairs, or similar seating devices for longer than fifteen (15) minutes. It was noted that children were placed in restraining devices for longer than 15 minutes. It was observed the educator placed children in devices and she sat in front of the children and watched them. No materials or moving children around while they were awake at this time which is required. (4) Playground Supervision. (b) Child care agencies shall develop and follow a written playground supervision plan that includes: 6. Roll call before leaving classroom and upon arrival at playground and prior to leaving playground and upon arrival in classroom. It was noted that the educator and person in charge in the Toddler 2 classroom did not complete a roll call before going onto the playground or coming back in from the playground. It was noted that the educator opened the door and all the children ran outside and the educator followed the children. When the children came back into the classroom it was noted that all children walked in and the educator set the clipboard on the table and took a seat while the children started to play in the classroom. 1240-04-01-.08 Records (3) Staff Record Requirements. (c) Staff records shall include the following information for each staff member: 4. Documentation signed by the examining licensed physician, nurse practitioner or physician's assistant, verifying that the staff person is physically, mentally and emotionally capable of safely and appropriately providing care for children in a group setting, if the staff person is an educator, owner, operator, director, manager, or will otherwise have unsupervised access to children. The documentation shall be on file within ten (10) calendar days of employment or work start date; One educator started working on June 5, 2023, and has not completed a physical which is required within ten calendar days of employment. (3) Meal and Snack Time Supervision. (a) During meal and snack time, staff shall maintain direct supervision of children between six (6) weeks and five (5) years of age and maintain supervision of children between six (6) and nine (9) years of age. (b) During meal and snack times, educators that are providing supervision are prohibited from engaging in any activities unrelated to mealtime while children are eating. Infant/Toddler room it was noted that the educator left two children at the table eating. The educator was walking around the room getting items out of children's diaper bags. The educator had her back turned several times at the sink while the children were eating.

See Below for Detailed Information Observation: During an unannounced visit to the agency on May 18, 2022, for the purpose of a complaint investigation, LC Linda Dowsey learned that an educator had placed a bottle warmer on the floor within reach of the infants. Then both educators in the classroom at the time turned their back to the bottle warmer and started working with other children. An infant crawled to the bottle warmer and pulled it over onto his foot/ankle causing injury. 1240-04-01-.11: SPECIFIC REQUIREMENTS FOR CHILD CARE CENTERS. Corrective Action: LC Dowsey gave TA and reported to DCS. Training is being scheduled with CCR&R on this topic Observation: During an unannounced visit to the agency on May 18, 2022, the agency was cited for sixteen (16) violations. Of the sixteen (16) violations, fourteen (14) are considered to place children at a high risk of harm. It is the managements responsibility to ensure that the agency and its staff are in compliance with licensing rules and regulations. 1240-04-01-.06 STAFF. Corrective Action: LC Dowsey has given TA to Owner/Directors as well as person in charge. Training is being scheduled. 1240-04-01.13 FOOD AND FOOD SERVICE (1) Meal and Snack Time Procedures. (2) (m) Prevention of Injuries by Bottle Warmers and Microwaves: The use of bottle warmers is not prohibited but is not recommended by the Department Based on interviews and documentation an infant was injured by a bottle warmer. This infant received 2nd degree burns and required medical treatment. 1240-04-01-.12 HEALTH AND SAFETY. (1) The onsite staff shall be responsible for the daily health and safety of children in care. (2) The child care agency shall ensure that the child care environment and practices support child health and safety. (13) Medications. (a) Receiving Medications. 1. All medications and all preventative products, such as non-presecription diaper cream, sunscreen and insect repellent, shall be received from the parent/guardian by a designated staff person or persons. 2. The designated staff person(s) shall: (i) Obtain the parent’s/guardian’s written authorization to administer each medication; (ii) Document that the medicines or drugs are in the original not just prescription drugs but also other container, are not expired, and are labeled with the child’s name; (iii) Document the specific dosage and times the medication is to be administered to the child; and (iv) Document that the parent/guardian has provided the child care agency with instructions on the means and method of administration. (b) Administering Medications. 1. All medications and all preventative products, such as non-presecription diaper cream, sunscreen and insect repellent, shall be administered by a designated staff person or persons. 2. The following documentation shall be maintained in the child’s file and a copy provided to the parent/guardian: (i) Medication was administered according to parent/guardian or health care provider instruction, including times and amounts of medications administered; (ii) Any side-effects observed; (iii) Name of staff person administering medication to child; and (iv) Unused medication was returned to the parent/guardian. Based on interviews with educators and the parent of an infant that was injured an infant was given medication (Neosporin and Tylenol) as first aid for a burn. The parents had not completed a signed permission form to administered these Over the Counter medications to the infant. Observation: Based on interviews and documentation a bottle warmer was placed on the floor and the educators had their backs the infant when he was burned. 1240-04-01-.06 STAFF. Observation: On June 11, 2019, it was confirmed by video that a child was left unsupervised in a classroom as a form of discipline. It was also observed that an educator left her classroom to search for that child when he left the room where he was unsupervised, leaving 7 children unsupervised during nap time. 1240-04-01-.11 SUPERVISION. Observation: On June 11, 2019 PE confirmed that the owner and director, did not demonstrate that they had selected, trained or supervised and evaluated staff performance appropriately to ensure that children would receive quality care. 1240-04-01-.06 STAFF. Observation: On June 11, 2019 it was confirmed by video that a child was inappropriately disciplined by being shoved into a room alone and not allowed to join his class. The child was also jerked by the arm and yelled at by an educator. 1240-04-01-.15 PROGRAM, LANGUAGE, AND LITERACY DEVELOPMENT. Observation: On June 11, 2019 PE confirmed that when their educator left the room to further discipline a child in the room next door, she left her classroom out of ratio and with no caregiver.
