  0520-12-01-.06 Program Operations. (6) Each program shall have a written playground supervision plan that includes: (b) Supervision assignments of staff to assure that all areas of the playground can be seen so that all children can remain within sight of the teachers; (c) Identification of which staff will merely supervise in their assigned zone while other staff, if any, interact with children as play facilitators. An incident occurred between two children on Thursday, April 23, 2026. One child was going down the slide while the other child was going up the slide. The child going up the slide wanted the child going down to move, that child refused. It resulted in the child going up the slide to bite the child going down on the private parts. While investigating the incident I learned that staff were not stationed to observe all areas of the playground and was not there when the incident occurred. On April 30, 2026, the corrective action plan was returned by the Director with the following measures implemented to prevent the incident from recurring. Staff have completed training in outdoor safety, health and safety policies and procedures, and the "Thumbs Up" supervision strategy. Certificates verifying completion of these trainings were provided. The program also submitted a playground policy, a playground supervision plan, and a playground diagram indicating where each teacher is assigned while supervising children outdoors.

See Below for Detailed Information During a review of employee files, not all employees had evidence of three verified references in their file. All employees must have three verified references on file in the program. CHAPTER 0520-12-01-.05 4. At least three (3) references from non-relatives, either written or with documented interviews of each reference on each staff member; During a review of employee files, some employees did not have a physical exam statement from a health professional. All employees are required to have an updated health statement every 3 years. CHAPTER 0520-12-01-.05 3. Documentation signed by the examining licensed physician, licensed psychologist, licensed clinician, Nurse Practitioner, or Physician’s Assistant, verifying that the staff person is capable of safely and appropriately providing care for children in a group setting. The documentation shall be on file within ten (10) calendar days of employment or starting to work. An updated statement of each staff member’s physical health shall be obtained every third (3rd) year, or more often if deemed necessary by the Department; Employee was permitted to work and have access to children with prohibited indications on his background check. Employee had access to children from 1/13/22 until 2/1/22. Individuals with pending criminal actions involving violence or the threat of violence against another individual are excluded from working at a school-administered child care program. CHAPTER 0520-12-01-.07(16) No individual with a prohibited criminal history as defined below may work, substitute or volunteer in a program, be an owner, director or manager of a program who has access to children, have significant contact with children or otherwise have unrestricted access to children in any manner whatsoever. An individual shall be immediately and automatically excluded from a program or any contact whatsoever with children if the individual’s criminal history includes: (a) A criminal conviction or a no-contest or guilty plea; or any pending criminal action, including individuals subject to any warrant, indictment or presentment, etc.; or placement in a pretrial diversion; or (b) A pending juvenile action or previous juvenile adjudication, which, if an adult, would constitute a criminal offense; and (c) Any of the circumstances in (a) or (b) above involves any of the following criminal offenses: 1. Any offense (including a lesser included offense) involving the physical, sexual or emotional abuse or gross neglect of a child or involving a threat to the health, safety or welfare of a child; 2. Any offense (including a lesser included offense) involving violence, or the threat of violence against another person; and/or 3. Any offense (including a lesser included offense) involving, the manufacture, sale, distribution or possession of any drug.
