(6) Incidents, accidents and injuries shall be reported to the parent as soon as possible, but no later than the child’s release to the parent or authorized representative. (a) Incidents, accidents and injuries to children shall be documented immediately as follows: 1. Date and time of occurrence; 2. Description of circumstances; and 3. Action(s) taken by the program. (b) Documentation of incidents, accidents and injuries to children shall be filed in the child’s record no later than one (1) business day immediately following the occurrence. (c) The Department shall be notified of any child fatality at the program no later than one (1) calendar day immediately following the death. The complaint stated that the child was attempting to throw the other child in the pool as he was monitoring the counselor throwing the children in the pool. The complaint stated that the children wait in line to be thrown in the pool by the counselor. (2) Every staff person, including auxiliary staff, substitutes, volunteers, and practicum students, shall be physically, mentally, and emotionally capable of using the appropriate judgment for the care of children, and otherwise performing his/her duties satisfactorily. A person who has a physical, mental, or emotional condition which is in any way potentially harmful to children shall not be present with the children.(6) Within the first two (2) weeks on the job and annually thereafter, each employee, including directors, teachers, substitutes, volunteers, and practicum students, shall receive annual instruction in:(g) Supervision during high risk activities such as eating and outdoor play.
